Former Astro Craig Biggio on Hall of Fame vote: 'It's the reality of the era'

AP  HOUSTON -- Craig Biggio thinks he might have been bypassed for the Hall of Fame because he was on the ballot for the first time with several big stars linked to performance-enhancing drugs.

Biggio received the highest vote total in a year that produced no electees to Cooperstown on Wednesday. Biggio, 20th on the career list with 3,060 hits, appeared on 68.2 percent of the 569 ballots -- 39 votes shy.

Steroids Era stars Barry Bonds, Roger Clemens and Sammy Sosa were also on the ballot for the first time and all fell far short of the required 75 percent. Biggio thinks it's unfortunate if he was lumped in with others associated with performance-enhancing drugs

"I think it's kind of unfair, but it's the reality of the era that we played in," he said. "Obviously some guys are guilty and others aren't, and it's painful for the ones that weren't."

He wasn't completely sure whether feelings about the others played a role in his coming up short.

"I can't get in the minds of the writers, but it's a possibility that that could have definitely been part of the deal," he said.

Later, he seemed to tire of the incessant questions about whether being on the ballot with players linked to steroids kept him out of the Hall of Fame this year.

"All I know is that I went out there and played the game and I loved the game and I went out there to win, and we have a lot of flags on that wall out there that represent that, and that's really the most important thing to me," he said.

He thinks he probably also was hurt by the preference of some writers not to vote for first-time eligibles. Biggio, who played his entire 20-year career with the Astros, was disappointed but says the exclusivity of the Hall makes it mean that much more when one gets in.

"When you look at the Hall of Fames, that's what makes baseball pretty special, pretty unbelievable. We're not letting six guys in every year," Biggio said. "You had a list of a lot of guys that were very qualified and nobody was let in. It just says a lot about how special that building really is."

Biggio retired after the 2007 season as Houston's leader in games, at-bats, hits, runs, doubles, extra-base hits and total bases. He is second in franchise history in RBIs and stolen bases and has the third-most home runs.

Voting is done by writers who have been members of the BBWAA for 10 straight years at any point. Biggio doesn't have a vote, but said he would have voted for both Bonds and Clemens if he did.

"Barry Bonds was the greatest hitter that I've ever played against ... and Roger was one of the greatest pitchers of all time," he said. "I would have yes, I think those guys are Hall of Fame players. Barry and Roger, their numbers speak for themselves and what they did on a baseball field speaks for itself."

Fellow Astro Jeff Bagwell also was among the top vote-getters with 59.6 percent. He debuted in 2011 with 41.7 percent and jumped to 56 percent a year ago.

Biggio said it would be special to get inducted alongside his longtime teammate and friend.

"We got a 68, and I'm going to go back and study a little harder and hopefully get a 75 next year," Biggio said with a chuckle.

Former President George H.W. Bush remains hospitalized in Houston

HOUSTON (KTRK) -- Former President George H.W. Bush will not leave a Houston hospital until he's made a full recovery.

A Bush spokesperson says the former president has had a few days where he hasn't had much energy, so doctors at Methodist Hospital are putting off his discharge until he's fully recovered.

Bush had been expected to go home sometime this weekend.

The 88-year-old has been in the hospital since Thanksgiving for treatment of a lingering cough related to bronchitis.

Former President Bush to remain in hospital

AP  HOUSTON -- Former President George H.W. Bush spent Christmas in a Houston hospital with his wife, Barbara, and other relatives who planned to treat him to a special holiday meal.

Bush's son, Neil, and his wife also visited on Tuesday, and one of Bush's grandsons was planning to stop by as well, said Jim McGrath, Bush's spokesman in Houston.

The 88-year-old has been in the hospital since Nov. 23 with a lingering, bronchitis-like cough. A hospital spokesman had said Bush was likely to be released to spend Christmas at home, but then McGrath said the former president developed a fever.

Doctors remain "cautiously optimistic" Bush will recover, but want to keep him in the hospital while they help him build up his strength and balance his medications, McGrath said.

On Christmas, the Bush family normally eats at Gigi's Asian Bistro in Houston's Galleria neighborhood, McGrath said. There were plans to pick up food at the upscale restaurant and bring the meal to the hospital.

Bush has been receiving visitors for weeks, including two by his son, former President George W. Bush, and one by Jeb Bush, former governor of Florida.

Bush and his wife reside in Houston during the winter, and spend their summers at a home in Kennebunkport, Maine.

The former president was a naval aviator in World War II -- at one point the youngest in the Navy -- and was shot down over the Pacific. He achieved notoriety in retirement for skydiving on at least three of his birthdays since leaving the White House in 1992.

Transitional home for former inmates raises concerns

HOUSTON (KTRK) -- A facility that helps women recently released from prison is under debate, as the location of Angela House is being considered.

The archdiocese is considering moving the home from its current location in north Houston to Our Lady of Mount Carmel Church on the southeast side, and not everyone is on board with that idea.

Delfina Echavarria is raising her four daughters across the street from to Our Lady of Mount Carmel, but now, she's worried.

She said, "I'm just scared of the unknown, what it will bring to the area, to the neighborhood."

She's upset because the archdiocese is planning to move a transitional women's home to the Mount Carmel campus. Angela House is currently on the city's north side, where it houses 10 to 15 women recently released from prison. Sister Maureen O'Connell is the program's founder.

"This is important work," she said. "Women who choose to make a change in their lives need all the support they can get."

Supporters point out all the women who would live at the home have been thoroughly screened before they can participate in the program, but the residents nearby say this is simply not what they want.

June Adams, a concerned neighbor, told the Houston City Council, "We support sisters' ministries, but our primary concerns are for the safety of the children and the many elderly people who live in that neighborhood."

Both sides took their concerns to city hall this week. Council member James Rodriguez supports the neighbors, but admits there may be no legal way to stop the project.

"Hopefully they'll be good neighbors, but I still oppose this facility," Rodriguez said. "There's no city money. This is not a city project. This is brought to us by the archdiocese."

Frustrated neighbors say they vow to return to city hall or protest anywhere else they can. Late Wednesday afternoon the archdiocese released a statement that said the cardinal supports Angela House, its mission and its move to Mount Carmel.

Former apartment manager accused of stealing rent money

HOUSTON (KTRK) -- A former apartment manager is accused of stealing more than $118,000 from tenants' rent money.

Rosalinda Herrera was working as the manager of Mapletree Gardens Apartments in 2009, according to court documents, when the management group over the property discovered a theft. They confronted Herrera and fired her, and she reportedly admitted taking the money and agreed to repay about $9,000.

Court documents state that Herrera reportedly would offer unauthorized discounts for rent payments that were made in cash or paid in advance. She was said to have changed money orders into her own name, and allegedly made adjustments in the accounting books to cover up the thefts.

When cleaning out Herrera's office, the manager for the property management group reportedly discovered cash and money orders that corresponded to rent payments deposited into Herrera's personal account totalling more than $118,000, court documents state.

Herrera, 34, is charged with aggregate theft, a felony charge. Bail in the case has been set at $104,000.

Former non-profit employee with thousands of porn images gets prison

AP  HOUSTON -- A Houston man who had more than 17,000 child pornography images and videos has been sentenced to 6 1/2 years in prison.

A federal judge in Houston on Friday sentenced 64-year-old Christopher Clark Pollett. Pollett in November pleaded guilty to possession of child pornography in a 2010 case.

Investigators say Pollett worked for Neighborhood Centers Inc. The nonprofit group deals with community development and after-school programs. Organization officials did not immediately comment Friday.

The FBI in June 2010 searched Pollett's home. Authorities say several computers, film reels, books and binders had thousands of images of children. About 17,000 digital images and 400 child porn videos were located.

Pollett must also pay $21,000 in restitution to three child victims and a $7,800 fine. Further details on the victims weren't released.

Squatters cause problems for former homeowner

HOUSTON (KTRK) -- One local woman is locked in a real estate headache. She moved out of her home to avoid foreclosure and now she says someone is squatting in her former house. That's causing big problems with the mortgage company.

Days after she moved out, Katrina Collins says she got a call from her mortgage company, questioning her as to who she let move into her home. She had no idea what they where talking about. Now she knows. They're squatters refusing to leave.

Collins moved out of her home of 14 years last month. Days later, she discovered a squatter had settled in and refused to leave.

"She said, 'I'm not going to argue with you, but I'm not going anywhere. If you want me out you need to evict me.' That's what she said to me," Collins told Eyewitness News.

Collins was in a financial bind and to avoid foreclosure she agreed to a "deed in lieu." The mortgage company paid her $2,000 to relocate and they took possession of the home. After she moved out, the mortgage company learned someone else moved in, and even brought the family pet.

"I got a call from the mortgage company asking me had I leased out the property because there was someone living here that said that they were leasing the property from me," said Collins.

The squatter wouldn't come to the door, but claimed to Collins she filed adverse possession on the home. It's a real law, but doesn't allow for someone to just move in.

"There is such a doctrine, such a law in Texas, and if you live somewhere for 10 years adverse to somebody else's interest, you can acquire an interest in the property, but you have no right to simply live there during that period," said Richard Alderman, The People's Lawyer.

The squatter has changed the locks and is in the process of being evicted. Collins says they're not squatters, just thieves.

"I think that they are fraudulent and they are stealing a place to stay. They don't have any rightful ownership to this property. They don't have the right to be here. They saw an empty house, they took advantage of it and they just moved in," Collins said.

The mortgage company has settled with Collins and she has moved to a different area. As for the squatters, they still refuse to move out, so the mortgage company is having to legally evict them.

Former drug-using doctor opens up about recovery

HOUSTON (KTRK) -- Five years ago, a Montgomery County doctor left his medical practice in disgrace, and now we're hearing from him for the first time. Back then, when his drug use made headlines, he was in denial, but today, Steve Farber comes clean.

It is a small office inside a two-bedroom apartment. But for Farber, this is success.

"I could easily be dead," he said.

It's a realization five years in the making after a very public fall from grace.

"How far did you fall?" we asked Farber.

"I hit rock bottom," he said.

That was in February 2007. Farber's medical license had just been suspended indefinitely.

"Very suddenly in the blink of an eye, my career was over," he said.

His world was unraveling.

"I was a closet addict," Farber said.

He had been exposed.

"I had led a double life, a secret double life, and I got very good at it," Farber said.

Dr. Farber was on top of the world. He had served twice as the head of cardiology at Conroe Regional Medical Center, had his own practice and had founded a non-profit -- all the while he was using drugs.

"Cocaine and I was using Xanax at the time," he said. "I did start using crack."

It was a downward spiral that could have affected many patients.

"And operate on patients?" we asked him.

"Yes, yes," he said.

And it did affect, he says, one in particular.

"I lost a friend," Farber said.

In April 2006, he prescribed a strong cough medicine to 33-year-old Gara Gerber. She was staying with him. He came home from work and she was dead.

"Whether she intentionally took her life, I don't know; whether it was an accidental overdose, I don't know -- I'll never know. But the reality is I should not have given her the prescription," Farber said.

Conroe police ruled Gerber's death an accident and Farber was never charged. It did cost him is medical license indefinitely. The Texas Medical Board in 2007 called him a continuing threat to public welfare, but it also it forced him to get help.

"They saved my life," Farber said.

Farber spent two months in intense rehab and says he's been clean ever since. He also wrote a candid book

"We are as sick as our secrets," he said.

He hopes will not only help other addicts but also raise awareness of prescription drug abuse. Whitney Houston and Michael Jackson are famous faces, he says, of a big-time problem.

"As a society, we cannot live in denial," Farber said. "I don't feel like a pariah anymore."

Today, Farber says his life is back on track. He is now deciding whether to appeal to the medical board to be able to see patients again.

"It's something that is not my identity anymore," he said.

From a luxurious house in The Woodlands to a small apartment in Spring, just being here is success Farber says far more satisfying.

"I feel that my life has turned around and I'm given a second chance to live to be the person I want to be and I want to take advantage of that," he said.

Farber settled a civil lawsuit out of court with Gerber's family. He told us he hopes one day her family will forgive him and to that her sister, Gena Gerber-Hopp, told us:

"Seeking forgiveness is not stating you wish it but rather it is actually taking the steps to actively pursue it. As a Christian I am taught to forgive, but that does not mean by any means my family and I will ever forget Steve Farber's role in my sister Gara's untimely death.

"We believe that the Texas Medical Board has failed the people of Texas in allowing Steve Farber the chance to practice medicine in any form ever again. But I do pray for his sake and his families that he does stay clean this time. My family and I miss my sister Gara so very much and we pray that no family should ever have to go through losing there loved one like this."

Farber's medical license has been reinstated but restricted to an administrative capacity. His book is now available on amazon.com.

Former Harris Co. judge staffer charged with fraud

HOUSTON (KTRK) -- A former staff member of a Harris County judge is charged with fraud after allegedly stealing thousands of dollars from a private nonprofit organization.

A felony arrest warrant was filed Friday for Kirk Boudreaux. He is charged with misapplication of fiduciary property for between $100,000 and $200,000 -- a second degree felony with a possible sentence of up to 20 years in prison.

In a way, these charges are not entirely surprising.

Harris County Judge Ed Emmett fired Boudreaux back in March after he discovered irregularities in the books of the nonprofit HC Events Inc.

Boudreaux, 48, served as volunteer for the nonprofit, but he had a full time job in Judge Emmett's county office.

Prosecutors allege Boudreaux made numerous personal purchases and wrote himself checks from the nonprofit's accounts.

We tried contacting both the suspect and Judge Emmett on Saturday. Neither was available for comment.

Former Rocket Jordan Hill facing charges, accused of choking family member

HOUSTON (KTRK) -- Former Rockets forward Jordan Hill is accused of choking his girlfriend of two years during an argument at his Houston area residence.

According to court documents, his girlfriend told police that Hill, who now plays for the Los Angeles Lakers, assaulted her and choked her, causing bruising to her body and restricted her breathing on February 29, when he still played for the Rockets. He was traded to LA on March 15.

Hill's girlfriend says she flew into Houston from Florida to see him and they got into an argument while discussing their future. During the argument, she says she threw his cell phones to the floor. She told police that Hill then punched her in the legs, grabbed her, pulled her off the couch and dragged her to where the phones were, and threw her against the wall.

Court documents state Hill demanded that she pick up his phones, and when she turned away from him, Hill grabbed her from behind and put her in a chokehold in which she couldn't breathe.

His girlfriend told police that she told Hill she wanted to go home and he booked her a flight back to Florida. Police say her friend picked her up from the airport and stated she was not herself and that she saw bruises on her legs and upper body.

According to police, they obtained photos of the injuries from Hill's girlfriend that were consistent with her and her friend's statements.

Hill, 24, is charged with assault of a family member. No bond has been set yet in this case.

Hill is in Los Angeles now with the Lakers where they have an off day in the playoffs. He is charged with the third degree felony, but has not been arrested.

He will have to make an appearance in Houston to face the charge. The Harris Co. District Attorney's office says Hill faces up to 2 to 10 years in prison and a $10,000 fine if he's convicted.

The Lakers say they're not commenting on the incident and referred questions to Hill's representative.

Hill issued a statement Monday afternoon which read:

"I'm saddened to learn of the accusations that were filed against me today. A this time I cannot comment further other than to say that my attorneys are working to gather all of the facts and evidence and I plan to cooperate completely with the authorities.
"I'd like to apologize to the Lakers organization and to all their fans for the untimeliness of these accusations. I promise to keep my focus and attention on the playoffs during this time and to helping my team win another championship."

Hill added that he doesn't expect to miss any practices or games for the Lakers.

The couple lived in the Houston area for decades. Police say they were in therapy, when the husband admitted to having an affair with a Missouri psychiatrist and brought up the possibility of a divorce.

Investigators say that prompted O'Roark Griffin to go shoot the mistress to death.

Neighbors upset over poorly maintained former golf course

HOUSTON (KTRK) -- They used to live next to a golf course, neatly maintained with a quaint little pond. But after the city purchased the land, neighbors say things went downhill fast.

Now they're even worried about their safety. And when they couldn't get any answers, they turned to Eyewitness News for help.

The good news is, the part of the old golf course in question was being mowed before the end of the day. The bad news is, it took neighbors months of complaining and finally talking to Channel 13 before anyone would fix it.

If you look on Google maps, the neighbors in the 7700 block of Antoine used to border a well-manicured golf course. These days, not so much.

"The weeds here, they're quite high," said neighbor Josefina Valague. "We can't walk through here, there's snakes."

The city of Houston bought the old Inwood Forest Country Club last summer. The Near Northwest Management District signed a lease with the city, agreeing to mow the course "not less than nine times a year." They told Eyewitness News in a statement "it is being allowed to return to a more natural state to become a green space and wildlife habitat."

But the neighbors here say it's a little too green and wild.

Neighbor Mildred Foster said, "I'm tired of it and they won't do nothing about it."

Valague says her daughter has complained for months about the problem.

"They refuse to talk to her," she said.

Eyewitness News tried to find out why no one's mowed back here. The president of the Near Northwest Management District emailed us, saying it's a pond that's to blame. It's tough to get a mowing tractor between the pond and the neighbors' properties.

"It was maintained before," Valague asserted.

That's changing, after Eyewitness News asked about it. In that same email from the management district we were told they "expect the mowing to be completed by the end of the day." Around 5pm we spotted a tractor out on the former course doing just that.

Eventually the plans for the old golf course call for a bike path and the Harris County Flood Control District says the property will help with flood control. In the meantime, the neighbors say they just want the part of the course bordering their properties kept up.

Harry Leroy Kelley, 56, was convicted in February of possession of stolen ammunition and two counts of conspiracy to commit mail fraud, according to the U.S. Attorney's Office.

HOUSTON (KTRK) -- A veteran Liberty County police officer was sentenced on Thursday to one year and one day behind bars for firearms and mail fraud violations.

Harry Leroy Kelley, 56, was convicted in February of possession of stolen ammunition and two counts of conspiracy to commit mail fraud, according to the U.S. Attorney's Office. He is a former Cleveland Police Department officer and Liberty County Sheriff's Office captain. Kelley was indicted in August 2010 after an investigation determined that he had been exchanging firearms and ammunition manufactured exclusively for the use of qualified law enforcement officers for 86 new weapons that he could sell to customers of his business, K Ventures. He is also convicted of ordering six Glock training pistols under the premise they'd be used by the Cleveland Police Department when they were, in fact, being purchased for a non-law enforcement individual. Kelley also devised the same scheme to purchase laser sights. He made the order, claiming it was meant for the Liberty County Sheriff's Office when the items were bought for someone outside the law enforcement field. This case was investigated by the ATF, the Texas Rangers and the Cleveland Police Department. (Copyright ©2011 KTRK-TV/DT. All Rights Reserved.)

Former teacher under investigation for child porn

HOUSTON (KTRK) -- A former Klein ISD teacher has been charged with viewing child pornography while on the job at school. The teacher worked at Hildebrandt Intermediate, before he left the job nearly seven months ago. Now he's wanted by police.

Law enforcement is looking for a former teacher at Hildebrandt Intermediate School, who is accused of having child pornography on his work computer. An arrest warrant was issued for Orville Blaine Sanders on Monday. He's accused of possession of child porn. Sanders supervised students during in-school suspension.

The investigation started back in October and law enforcement says illegal images were found on his work computer.

We received a statement from Klein ISD that says in part, "Mr. Sanders admitted visiting inappropriate sites during his employment with Klein and then promptly resigned."

Klein ISD also says none of the images found on Sanders' computer were of students. He allegedly downloaded them from websites.

Klein ISD did not make anyone from Klein ISD Police Department available to talk about the investigation.

Sanders worked for the school district for eight years and has no criminal history. According to court documents, he heard about the child porn websites from students and he continued to visit the websites for "shock value."

Former Enron exec Fastow moved to Houston halfway house

HOUSTON (KTRK) -- Former Enron executive Andrew Fastow is out of prison and back in Houston.

Published reports say Fastow was moved from a prison in Louisiana to a halfway house in the Houston area. He's expected to remain there until December. Fastow was considered the mastermind behind the financial schemes that led to Enron's downfall.

He pleaded guilty to conspiracy charges in 2006 and was sentenced to six years in prison.

Fastow received a reduced sentence for testifying against former Enron CEO Jeff Skilling and Kenneth Lay. Lay and Skilling were convicted of fraud and conspiracy. Lay died before going to prison. Skilling awaits resentencing after the supreme court overturned his 24 year sentence.
