Friendswood woman charged with deadly conduct after alleged drunken rampage

  FRIENDSWOOD, TX (KTRK) -- A Friendswood woman is accused of deadly conduct after allegedly trying to run over her husband with a vehicle.

It happened just before 3pm Thursday in the 1100 block of Eagle Lakes Drive.

Michelle Lee O'Donnell, 40, is charged with deadly conduct-family violence.

According to police, O'Donnell drove over a curb and into her yard that afternoon. She then drove directly toward her husband as he was standing behind his truck in the driveway, placing him in danger of serious bodily injury, officials said.

She reportedly slammed into the back of his truck, but he was able to get out of the way. We're told she also got her vehicle stuck in the grass and then backed out into the street before she drove away. She was allegedly intoxicated at the time, officials said.

When officers arrived, they used the suspect's husband's cell phone to track her current location and a warrant was filed in Galveston County.

Police were called back to the residence around 8am Friday and found O'Donnell leaving the area. Officers stopped her vehicle as it entered League City on F.M. 518 and O'Donnell was taken into custody.

Investigators said they found an open bottle of vodka in the vehicle and an open flask of vodka in her purse.

Harris Co. employees fired in connection to alleged sex scandal at county jail

  HOUSTON (KTRK) -- Six people entrusted with keeping law and order are now accused of violating the rules of the Harris County Sheriff's Office and breaking the law.

On Friday afternoon, Sheriff Adrian Garcia discussed the problem when he announced the results of an internal investigation.

The alleged sexual misconduct happened inside two jail facilities on Baker Street in downtown Houston -- the bigger detention center and across the street at the minimum security location.

Garcia says at both locations, the sexual activity happened inside the laundry room where there are no surveillance cameras. That's changing...and so is his staff.

"Their actions are inexcusable," said Garcia. "Today, I fired employees who have been employed here for over 10 years."

Among those fired were four detention officers and one deputy. Additionally, a deputy resigned and another retired while under investigation.

They join former Deputy Tony Richards as casualties of the probe that started in August of last year. He was fired in February and is now charged with having improper sexual activity with an inmate.

The others, according to the sheriff, are accused of either having sex with inmates or with other employees or as supervisors looking the other way.

"While people are in our custody, we have laws and rules to abide by," Garcia said.

Dean Sierra was checking into jail for the weekend for driving with a suspended license when we told him about he sex accusations.

"It doesn't surprise me at all," he said.

"I hear it a lot, I really hear it a lot so it doesn't shock me," said Montasha Curtis, who was in downtown to post a bond.

None of the others involved in the scandal have been charged so far, but the case is being referred to the Harris County District Attorney's Office. Garcia didn't name them Friday, but said some of them have been working at the sheriff's office for more than 10 years.

Garcia said he blames the previous administration for a culture that allowed this. He also said the sheriff's office already has taken additional measures, like installing more cameras at the jail to make sure this situation isn't repeated.

Arrest made in alleged 'black magic' sexual assault

  TOMBALL, TX (KTRK) -- The search for a 60-year-old man accused of rape in Tomball has ended in his arrest. And now, the victim's family is speaking about the crime and how the man was finally captured.

Mario Munoz-Verudes is accused of assaulting a 17-year-old after claiming he could help her with black magic. According to the father of that teen girl, the man wanted for rape had been hiding from police not far from where the alleged rape took place back on September 25.

The father, who we're not identifying, says he knew Munoz-Verudes was hiding out in the woods behind the home and waited for him in an abandon house overnight. His son helped explain to us what happened.

"All of the fathers and mothers that have children, if they were to be violated, they would all feel the same," said the son. "Angry, mad and we wouldn't rest until we found the man."

According to police, the sexual assault happened at a home where Munoz-Verudes was renting a room from the owner. According to the girl's father, after finally finding Munoz-Verudes, they got into a physical altercation.

"He took out a knife and tried to stab my dad and that made him angry and what my dad did, he attacked him," said the son.

The girl's father tells us he was able to call police after the fight. Police arrested Munoz-Verudes early Saturday morning.

Police say Munoz-Verudes claimed he knew black magic and told the girl he would get rid of her bad spirits. This was allegedly his way to lure the girl into his home.

"Proclaimed himself to be a religious man, attended church regularly, supposedly, and was able to do some witchcraft or some spells," said Detective Ron McGullion with the Tomball Police Department.

Munoz-Verudes is facing a charge of rape. At this point, it's unclear when his next court appearance will be.

Suspect charged in alleged abduction of ex-girlfriend and her son

  HOUSTON (KTRK) -- Police have charged a man who they say abducted a woman and child yesterday morning that led to an Amber Alert briefly being issued.

Joseph Anthony Vallego, 21, is charged with aggravated assault with a deadly weapon and aggravated kidnapping. According to police, Vallego went to the northwest Houston home of his ex-girlfriend and her current boyfriend, held several family members at gunpoint and demanded that the ex-girlfriend and her 7-year-old son leave with him.

Vallego then allegedly left the home with the mother and her son in a red Ford Expedition.

The vehicle was spotted soon after in the parking lot of the Western Inn at 1500 North Loop West. Vallego was taken into custody without incident. The woman and her child were not harmed.

TSU investigating alleged hazing incident among university band members

HOUSTON (KTRK) -- As the Texas Southern University football team took the field Thursday night, something was missing -- the marching band. It was suspended and is now under investigation. The allegations against the Ocean of Soul are hazing.

Many people who attended the TSU game didn't know about the hazing allegations until it was obvious the band wasn't there. The band director, band staff and all students are being questioned, and if proven true, students could be expelled or even charged.

Halftime at BBVA Compass Stadium and the field is empty, which means the curb at the student shuttle bus stop is full. Many left early.

"There's no point of staying for 12 minutes and just sitting and looking at other people," freshman Didi Chiedu said.

For the game on September 15, the Ocean of Soul rocked. On Thursday night, their performance was canceled amidst hazing allegations.

TSU officials tell Eyewitness News they received the report Wednesday night. It involves the trumpet section and an allegation of excessive paddling. It's said to have happened September 19 off campus. There were no serious injuries but the university has a zero-tolerance policy for hazing.

According to a written statement, the university says "the band is suspended until further notice" and "TSU student affairs personnel will take appropriate action."

On Thursday night, we weren't allowed into the stadium for this story. Outside, students reacted to the allegations.

"It's not good, but it's hopefully not true," freshman Alex Coleman said.

"Usually you get this from fraternities and sororities, but from the band, which is a respectful organization at our school, it's ridiculous," Chiedu said.

This isn't the first time the band has been involved in a scandal, but it has been a long time. Twenty years ago while in Japan, students were accused of stealing thousands of dollars in electronics.

HPD officer fires weapon at alleged beer thief

  HOUSTON (KTRK) -- An alleged beer theft turned into a confrontation with police overnight with an officer firing her weapon.

Police say officers were driving by a convenience store on Dowling around 11pm Saturday when a clerk ran out yelling he had been robbed.

Officers stopped and the clerk pointed out a car and said the robber was inside. The driver obeyed police commands to come out with his hands up. They say a passenger in the backseat was moving around.

"The passenger in the back seat got out of the vehicle and started to make a move like he was going to get down on the ground then jumped up and made an aggressive move at the officer," HPD spokesperson Kese Smith said. "The officer, fearing for her safety, discharged her duty weapon one time, did not strike the suspect."

The officer is a 16-year veteran named P. Briscoe. The suspect fled and has not been caught.

The remaining suspects were taken into custody and police say they found a stolen 24-pack of beer inside their car.

Alleged meth lab fire results in charges

  HOUSTON (KTRK) -- Three people are facing trouble with the law after an alleged meth lab explosion caused a fire in May.

On May 24, Jason White was burned in a fire in the 17800 block of Paddle Wheel, in north Harris County. White, 32, was taken to Houston Northwest Medical Center for burns received when he was "injured by an explosive chemical reaction during the production of methamphetamine," could documents state.

Officials from the Harris County Sheriff's Office, Harris County Fire Marshal and Harris County HazMat all arrived at the scene of the fire. Authorities determined that White had allegedly been creating meth in a bathroom when the accident happened. They say he was shaking a bottle full of chemicals when a reaction occurred and the bottle exploded, burning his face, arms and hands.

Officials found broken batteries, drain cleaner, Sudafed, coffee filters and muriatic acid, all items known to be used in the manufacture of meth. White reportedly told deputies at the hospital that he had been "making meth and it exploded."

Thurman Hall and White's girlfriend, Lindsey Grice, both reportedly told officials at the scene that they knew White was making meth. Charges arson/manufacture of a controlled substance have been filed.

Another suspect accepts plea deal in alleged gang rape of Cleveland girl

  HOUSTON (KTRK) -- There's yet another guilty plea in the repeated rape of an 11-year-old Cleveland girl. That makes four guilty pleas in the past 24 hours.

Rayford Ellis Jr. pleaded guilty in court Friday. He follows three other men -- Kelvin King, 23, Jared McPherson, 20, and Tim Ellis, 20 -- who accepted plea bargains on Thursday.

All four men will be sentenced September 21.

In all, 20 adults and juveniles were originally charged in the case for allegedly sexually assaulting a then 11-year-old girl on multiple occasions in 2010. Most have accepted plea bargains including all of the juveniles.

The only person to go to trial so far has been Eric McGowen. Last week, he was convicted and sentenced to 99 years in prison, but he walked out of the trial and hasn't been seen since.

Man arrested following alleged Craigslist caper involving stolen ATV

HOUSTON (KTRK) -- A man has been arrested following an alleged Craigslist caper. Deputies say the man stole an all-terrain vehicle, then tried to sell it on the website for thousands of dollars.

A Cypress man has a cautionary tale about doing business on Craigslist. Not only did he buy stolen property, but he also lost the four wheeler he was trying to trade.

Jordan Griffith was looking to trade up for his 2006 Yamaha YZF four wheeler. So back in April, he logged on to Craigslist, and went to the ATV section, found this blue 2011 Kawasaki Teryx and made a deal with the seller.

"It was my four wheeler and cash for the side by side, and the deal didn't go through," Griffith told Eyewitness News.

It didn't go through because he was dealing with 26-year-old J'Gerrard Drik Thibedeaux. As of September 3, he was arrested and charged with burglary of a habitation for stealing the Teryx out of a garage.

Thibedeaux then posted it for sale on Craigslist. Without knowing, Griffith met him for the transaction. When he received a phony title, he knew it was a scam.

"At that point, they switched ATVs. As the victim was leaving, he was given the title to the ATV, and when he opened the envelope and found out it was a blank piece of paper, he knew something was not right," said Deputy Thomas Gilliland with the Harris Co. Sheriff's Office.

Griffith took the Teryx home and called the Sheriff's Office to find the rightful owner. They ran the serial number and Griffith contacted the owner.

"I called the lady the next day, and it was actually stolen out of her garage," he said.

To make matters worse, Griffith still has not gotten back his 2006 Yamaha YZF he was trading. He said he saw it also posted on Craigslist for a cheap price almost instantly and has not seen it since.

"You got to know who you are dealing with. If it sounds sketchy and too good to be true, than most likely it's sketchy," Griffith said.

The other thing that will leave your head shaking here is that investigators say Thibedeaux, the suspect, stole that Kawasaki Teryx from his friend's garage. Since he has a criminal history, he's being held without bond.

Cleveland site of alleged gang rape torn down

  CLEVELAND, TX (KTRK) -- A Cleveland house trailer at the center of a gang rape investigation that shocked the nation has been reduced to a pile of rubble.

The city of Cleveland tore down the structure on Ross Avenue this week. It had been scheduled for demolition even before it became the scene of multiple sexual assaults, allegedly committed against an 11-year-old girl back in 2010.

Twenty-one men, including seven juveniles, face charges in that case. Many of them have accepted plea deals.

Alleged drug dealer, gang member arrested in Montgomery County

  HOUSTON (KTRK) -- Detectives have arrested an alleged gang member and drug dealer after they say a search for is East Montgomery County home yielded drugs, gang paraphernalia and a large amount of cash.

Jesus "King Snoopy" Hernandez, Jr., 33 and his 26-year-old wife, Patricia Santos, were arrested early Friday morning at their home in the 19800 block of Ranch Estates Drive in New Caney, according to the Montgomery County Precinct 4 Constable's Office. Both face second-degree felony charges of manufacture/delivery of a controlled substance and third-degree felony money laundering.

Authorities say information gathered by investigators in Liberty County led them to Hernandez's home in New Caney. When they arrived there, Hernandez allegedly admitted to have previous involvement with the Latin Kings street gang and had once been a dealer. He told investigators he's willing to give up a small amount of cocaine, which he claimed was for his personal use, on the condition that his wife and four kids don't get involved.

But when authorities asked Hernandez for permission to search his home, they say he declined. That's when authorities drafted a search warrant and discovered more than one gram of cocaine, a powder commonly used by dealers to dilute the drug and a large amount of cash. They also found several assault rifles, more narcotics and a large amount of Latin Kings clothing and other gang paraphernalia, as well as evidence indicating Santos' involvement in the illegal drug activity.

Hernandez and Santos were then arrested and their four children were released to their grandparents.

The investigation is continuing and additional charges are possible.

Man charged in alleged day care molestation

Michael Oshay Hudson Michael Oshay Hudson, 39, is charged with indecency with a child and bond has been set at $30,000 in the case.

  HOUSTON (KTRK) -- Police have charged a man with indecency with a child in a 2008 case involving a seven-year-old boy.

Michael Oshay Hudson, 39, reportedly molested the boy at Shoelace's Learning Center, a day care facility at 5007 Higgins. The boy told authorities he was staying at the day care while his mother went to work, during June 2008. Hudson was reportedly the owner/operator of the facility at the time.

According to court documents, the boy told police that he was being punished and wasn't allowed to go outside with the other kids to play. He says he asked Hudson if he could use the computer to which Hudson reportedly replied the boy had to do something first. The boy says Hudson took him to a room with a bed and touched him sexually.

The boy told police that he told his mother about the incident at the time, but she was going through difficult time with unemployment and a potentially homeless situation and says she doesn't recall being told of the molestation. In 2012, when the boy's older brother was home from college, the boy told him of the incident at the day care.

The child identified Hudson from a police photo lineup. Hudson is charged with indecency with a child and bond has been set at $30,000 in the case.

Teachers investigated for alleged student cheating

HOUSTON (KTRK) -- Some Houston school teachers are under investigation because of allegations that they may have helped their students cheat on the TAKS test.

One teacher at Hobby Elementary School in southwest Houston has not been renewed and five more have been transferred from the school to other locations until the investigation is complete. Some parents are defending the teachers and want them back in the classroom with their kids.

The parents say they are proud of the work their children have done at the recognized and exemplary school.

"They are awesome teachers. They are the best. They have worked hard," said parent Elsy Fuentes.

So the allegations, reassignment of some teachers and the firing of another has taken them by surprise.

"We disagree with this action that HISD is taking," said parent Segundo Castro.

HISD says last week, five Hobby Elementary School teachers were reassigned to other job duties away from the campus pending the outcome of an investigation. A sixth teacher was dismissed.

The district says the Texas Education Agency received an allegation of testing impropriety against the school during TAKS testing in the 2010-2011 school year.

"I don't believe it, not at all, because they have really, really studied and worked hard for this," Fuentes said.

These parents wrote a letter to the district concerned about who they say are bilingual teachers being taken out of the classroom. They also claim that many Hispanic children who attend Hobby spent hours after school and on weekends preparing for the test.

"They had a lot of homework, going to sleep at 10 or 11 at night," said Fuentes.

The district says in February it "hired an outside law firm to conduct a preliminary investigation into this allegation. Some students were interviewed after their parents granted permission."

Castro said, "They are good teachers, honest teachers, and they work hard every day in school."

"We want this solved and we want it solved fast. Our kids are wanting their teachers back, they need their teachers," said Fuentes.

HISD says the investigation is not finished and no final conclusions have been reached on the five teachers reassigned.

Lating singer seeks tougher charges against alleged drunken driver

  HOUSTON (KTRK) -- A five-time Latin Grammy nominee says he wants tougher charges against a man he accuses of hitting him with a car.

Jessee Camacho was walking near El Franco Lee Community Center Park when he was hit by the vehicle. He suffered broken bones.

Eyewitnesses say they had to chase down the driver to get him to stop. In the end, the driver - Andrew Cross - was charged with public intoxication.

Mothers Against Drunk Drivers and LULAC held a news conference, saying the driver had been drinking at a BBQ cook off that day.

"When I found out it was just a PI. I was shocked because he was driving, that to me is a shocker," Jesse Camacho said.

According to the police report, officers didn't have a witness at the scene that placed cross behind the wheel, which is why he was only charged with public intoxication.

LULAC says the best witnesses were never interviewed by police.

Why won't county attorney discuss alleged attack?

HOUSTON (KTRK) -- Tonight a bizarre story: A county lawyer says she was brutally attacked because she's fighting human trafficking. But even her own boss admits there's no evidence.

We have an email trail that raises even more questions. And it gets more curious. When we wanted to see time sheets at the County Attorney's office as part of our investigation, somebody changed them, and we're crying foul.

This is the image Linda Geffin wants you to see -- her windbreaker emblazoned with the word 'LAW;' The head of Vince Ryan's special prosecutions unit, fighting human trafficking.

"Human trafficking is the fastest growing criminal enterprise in the world industry. It is a $32 billion industry," Geffin said in a TV interview.

So imagine the sympathy when the Houston Chronicle splashed this headline this month, 'Did assault victim pay price for crime fight?'

In it, Geffin says she was likely attacked in her home while she slept because she's fighting organized crime.

"You've got no evidence this is linked to human trafficking," we said.

HPD Sgt. JC Padilla replied, "That's correct."

We've been trying to get the County Attorney's office for weeks to talk about the Geffin attack. They said no.

"Wayne, I really can't do this. This is a security issue that is really not appropriate right now," said Assistant Harris County Attorney Terry O'Rourke.

But that didn't stop the County Attorney's office from then helping the Chronicle sound a public alarm

An unmarked county car now sits outside Geffin's home. But we know the county attorney turned down Geffin's request for a $22,000 security system for her home.

Geffin had compared her reported attack to "an officer down." In an email, Geffin says HPD confirmed it wasn't random. But HPD admits, they don't have a clue who did it.

"Right now, we're asking the public if they have information regarding what happened to Ms. Geffin to please contact us so we can keep this investigation active," said Sgt. Padilla.

Geffin woke up one Sunday morning in September with "considerable head pain, a swollen black eye." But she didn't call 911. A friend took her to the ER.

It was five days before Geffin told police. She admitted she has "no recollection of anything."

In this October email, Geffin admits she's uncertain "whether my house was broken into or if this is something different."

But by November, she's telling her bosses "fact is someone entered my house and assaulted me. I almost died."

In the Chronicle photo, Geffin is apparently able to now show us exactly what happened -- an uppercut to the chin.

Police say medical records show evidence of blunt force trauma. But HPD never sent a crime scene unit to her home, took no prints. Her home alarm didn't go off. Police can't even say where it happened.

"That's one of the things we did, is to see if there was forced entry into her house, not only from the inside, but from the outside," Sgt. Padilla said.

"No sign of that?" we asked.

Sgt Padilla replied, "No, there was not."

Houston police even tested DNA hair samples after Geffin complained. It turned out to be her hair. But she's been critical of the way HPD has handled her case.

"Everything HPD did was at my direction; they failed to do anything appropriate, not just according to me, but to other investigators in the LE community," she wrote.

That's cop lingo for law enforcement.

"I feel like I've been thrown under the bus by the HCAO and the HPD," she said.

We asked Vince Ryan, "Do you believe she was attacked because of her investigations of human trafficking?"

"There's no evidence directly linking that. It's an unfortunate situation, whatever the case may be," said Vince Ryan.

Vince Ryan didn't even call in the FBI to help, or Houston's Federal Task Force on Human Trafficking.

Even in the County Attorney's office, Geffin's case is controversial.

Her supervisor wrote, "It does concern me that she apparently was cleared by her doctor to work from home, but she is reporting she is making public appearances."

And putting as much as 13 hours a day on her time sheet with no one there to supervise exactly what she's doing for you. Geffin is not only making speeches, she's driving all around town. We even saw her shopping at Kroger.

But talking about Linda Geffin and her injuries is a sensitive subject downtown.

"I can't do that right now on television. It's most inappropriate and I think we'll discuss that another time," said Terry O'Rourke.

That's why we asked to see her time sheets. The date of our request was April 2. But look what happened -- her February time sheets were changed. The supervisor didn't sign them until after we asked to see them.

"When you see this, alarm bells go off?" we asked.

"Sure," replied Mike Post, Assistant Harris Co. Auditor.

And check out this time sheet signed by a supervisor seven days before Geffin signed it.

"I don't understand that at all," Post said.

But state law says its a crime to willfully "alter public information."

We complained when a Precinct 6 supervisor changed their time sheets after we asked to see them. Guess who we asked to help us enforce the law? The watchdog. Now we know they do it, too.

"You got to be disappointed; this is the County Attorney's office for gosh sakes," we said.

"I'm surprised," Post said.

Security system sales call ends with alleged sex assault attempt

See it on TV? Check here.   LA PORTE, TX (KTRK) -- A Conroe man is facing charges after allegedly trying to sexually assault a woman in her La Porte home last month.

Johnny Angel Lara, 23, is charged with attempted sexual assault. According to court documents, Lara went to the victim's home in the 5500 block of Sugar Creek on April 19 at around 6:30pm.

He reportedly appeared to represent a home alarm company and tried sell the victim a security system. The victim says Lara came inside the home to see pre-existing alarm equipment. She then reportedly told him she wasn't interested and asked him to leave.

Police say Lara walked towards the front door, but stood in the way of the door so that the victim couldn't open it. That's when court documents say Lara began telling the victim she had a nice body and began to touch her inappropriately and put his hands inside her clothes.

The victim told investigators that Lara tried to push her up the stairs in the home in order to have sex. She eventually was able to get the front door open, and Lara reportedly left.

Police obtained Lara's name and contact information from a flyer left at a neighbor's home. The victim reportedly identified him from a photo lineup.

Initially Lara told police he couldn't remember being in the neighborhood, much less in the victim's home. As they continued to question him, however, he admitted going inside the victim's home, but denied any physical contact. Bail has been set at $30,000.

Alleged Tranquility Park gunman ruled not competent to stand trial

  HOUSTON (KTRK) -- A judge has ruled that a man who allegedly fired a rifle in Tranquility Park in November is not competent to stand trial.

Joshua Anthony Twohig, 21, was found incompetent Monday morning and will be sent to Vernon Hospital for mental evaluation. He will be brought back to court on May 2 to determine if he has regained competency.

Investigators say Twohig waved a 40-caliber rifle during an Occupy Houston rally before putting the gun to his head.

Twohig's attorney says his client has a history of metal illness and that his plan was to commit "suicide by cop."

Much of the incident was captured on cell phone video by an Occupy Houston protester camped out nearby. Twohig was dressed in a black suit and carrying the 40-caliber assault rifle. Prosecutors say an officer, who was flagged down by a protester, found the young father firing in the reflecting pond, then the state says he turned and pointed the gun at the officer.

That's when one officer shot him and prosecutors say he dropped his rifle, reached in his back waist band and was shot again. Prosecutors say when he reached for his rifle again, he was shot a third time.

Twohig's attorney says his client did not plan to come out of the park alive.

"There is a plethora of material that indicates that he was delusional, that he exhibited paranoia, that he had in the past heard voices; he was very definitely not a member of Occupy Houston. He was out there all by himself and quite frankly intended to commit suicide by cop," said George Parnham, Twohig's defense attorney.

Parnham said Twohig was on his medication at the time of the shooting.

Alleged shoplifter arrested on homicide parole violation

  HOUSTON (KTRK) -- Harris County Precinct 6 deputies arrested a shoplifter who turned out to be wanted on a much more serious charge.

Deputies were called to a theft at Best Buy, located 510 Gulfgate Center, around 11:15am Saturday. They arrived and detained the alleged shoplifter as he exited the building.

Officials said Ruben Mendiola, 50, was in possession of about $269 worth of stolen merchandise.

They ran his name through a computer check and found out Mendiola had an outstanding parole violation warrant for a murder case that originated out of the Montgomery County Sheriff's Office in October 1983.

According to investigators, Mendiola was convicted of murder and sentenced to 35 years in prison. He was released on parole in 1999.

The parole violation warrant was confirmed by the State Parole Board and the suspect was taken into custody and transported to Harris County Jail

Alleged victim protests ex-cop's plea deal

See it on TV? Check here. HOUSTON (KTRK) -- Community activists are lashing out at the Harris County District Attorneys Office, alleging it was unfairly lenient in prosecuting a former police officer.

The allegation from community activists is that a former Houston police officer who pled guilty to theft was offered a better deal than someone facing a much less serious crime. They want to know why, and so does a man who says he was ripped off by that police officer.

Karim Saleem says he was minding his own business last May when Houston police officer Stefan Riha pulled him over.

"He pulled me over and took the money I just got from the mechanic," Saleem said.

After a few minutes in the back of the patrol car, the officer let Saleem go. That's when Saleem realized the $800 in cash he had in the car was gone.

He went to police who then conducted a sting operation and arrested Riha after he stole cash from an undercover officer posing as a motorist.

For pleading guilty, Riha received two years probation. He'll have to pay a $500 fine and do community service.

"Which is very unjust and unfair to me because had it not been for my testimony, he probably would still be out on the street robbing people to this day," Saleem said.

Saleem is upset because Riha was never prosecuted for allegedly stealing from him. The DA's office says they didn't have enough evidence to prove his claim. Community activists also say the punishment offered to Riha was far more lenient than that offered to some who have been charged with lesser crimes.

"We as a community are livid. This is very, very disturbing," activist Derric Muhammad said.

Muhammad says he watched a case just last week in court where Christopher Latson was accused of failing to identify himself to a police officer.

He was ultimately acquitted of that charge, but Muhammad says Latson was never offered any deal as lenient as Riha, even though Latson's case was a misdemeanor and Riha's was a felony.

Muhammad wonders if race or politics played a role.

"Why is it that a Houston police officer can get off with such a light sentence?" he asks.

The DA's office refused to answer questions for this story. They instead issued us a statement, in part telling us that prosecutors make offers and negotiate plea bargains based on a number of factors, including the facts of the case and a defendant's criminal history.

Steve Morris, chief of the governmental integrity bureau, said in a statement, "pursuant to our duty to see that justice is done, we do not consider or take into account a suspect's race, ethnicity, or gender in deciding on an appropriate sentence."

Four indicted in alleged hate crime beating of black man at bus stop

HOUSTON (KTRK) -- What allegedly happened at a Houston bus stop is now being prosecuted as a hate crime. Four white men are accused of attacking a black man.

Late one night last August, Yondell Johnson was sitting at a bus stop waiting for the bus when he saw four men approach him, throw a few racial epithets around, and attacked.

"It was like I couldn't believe this was happening, and I thought I could be dying especially when they had me on the ground," said Johnson.

On Thursday, Johnson says justice is finally being served because the four suspects -- Charles Cannon, Michael McLaughlin, Brian Kerstetter and Joseph Staggs -- have been indicted on federal hate crime charges, meaning that the motive behind the attack was Johnson's race.

"I knew it still happened, but right here in my own back yard -- not really," said Johnson

The indictment by the federal government is a result of a multi-month investigation involving the FBI, the Houston Police Department and other local authorities. It is significant because it's only the third time the hate crime statute has been used since it passed Congress in 2009.

"The message is not only is this a new tool for law enforcement to use, but the community needs to know the law enforcement people here in Houston are willing to use it," said Stephen Morris with the FBI.

Investigators say three of the men have white supremacist gang tattoos.

The four suspects were arrested at the scene following a 911 call. If convicted, each could face up to 10 years in prison.

All four are already facing charges in Harris County, but for Johnson this day is significant.

"I'm just glad the justice is coming to an end, and justice is finally served," said Johnson.

All four men are charged with violating the Matthew Shepard and James Byrd Jr. Hate Crimes Prevention Act. It was passed in October 2009 and it expanded a previous federal hate crime law to include crimes motivated by a victim's actual or perceived gender, sexual orientation, gender identity or disability. The act was the first federal law to extend legal protections to transgender persons.

James Byrd Jr. was the Jasper man who was dragged to his death from a pickup truck in 1998 by three white men. His murder led Texas to pass its own hate crime law in 2001.
