Homicide detectives probing baby's death in north Houston

HOUSTON (KTRK) -- A Houston father is under arrest after police discovered his child dead in north Houston on Thursday.

It happened around midday at an apartment complex in the 16000 block of City View Place, and the HPD crime scene unit spent the rest of the day scouring the scene for evidence.

Police were dispatched to the complex around 1:30pm after they received a call from someone claiming there was a child in cardiac arrest.

Police say it looked as if the two-year-old boy, who's been identified as Jashaun Davis, had been badly beaten.

According to an officer on scene, the toddler's father, Tyrone Jefferson, was questioned by detectives and told he them his son became unresponsive after a spanking. According to court documents, the toddler's head was struck against a wall. He was pronounced dead shortly after arrival at a nearby hospital.

Police say the mother was at work when the incident happened. She seemed completely devastated when she spoke with us Friday.

"I was gonna tell him to leave that same day. It was too late. I love that boy more than life itself," the boy's mother, Angela Davis, said.

Jefferson, 24, was later charged with capital murder.

Meanwhile, neighbors are still trying to figure out what happened.

"He looked innocent, like he wouldn't do something like this, but you know never know what's in people's mind," neighbor Evelyn Cloud said.

Woman found shot to death inside running SUV in SW Houston

HOUSTON (KTRK) -- Houston police may have a hard time solving a woman's murder. She was gunned down behind the wheel of her SUV, and there are few clues as to what may have happened.

The woman was found dead along Birdwood near Renwick in southwest Houston late Thursday night. She was killed just a couple of blocks away from her apartment complex, and the murder has her friends and neighbors very concerned right now.

Friends are leaving stuffed animals and balloons, building a small roadside memorial in memory of a woman who was shot and left to die.

"She was great," said Kim Ortiz, a friend of the victim. "She was funny, friendly."

Ortiz says the 29-year-old victim was her best friend. Police say the woman was driving her SUV when an unknown person shot her in the head on the 5400 block of Birdwood around 11pm Thursday. Several neighbors woke up to the commotion.

Neighbor Lew Williams said, 'Heard three shots, very loud. It sounded like it was bang... and then bang, bang."

Investigators say the victim wasn't robbed. And they're speculating road rage could have played a part in this murder. The woman's friends just want some answers.

"She was trying to get back on her feet," Ortiz said. "She was bettering herself. She was going to school."

Police believe the victim backed her SUV off the street and onto a field trying to escape the gunman. A neighbor passing by found her dead behind the wheel. Several witnesses told police they saw a black Tahoe speeding from the scene after the shooting.

"I hope that if somebody knows that person or knows what happened, they could say something. Because we're all wondering," Ortiz said. "We all just want to know something. Something needs to be done. Justice needs to happen."

Officials have not yet released the victim's name. Investigators are canvassing the neighborhood and looking for surveillance video.

Anyone with information in this case is urged to contact the HPD Homicide Division at 713-308-3600 or Crime Stoppers at 713-222-TIPS.

Man charged in wife's shooting death last month reportedly killed himself Thursday

Thomas A. Quinlan Thomas A. Quinlan, 58, had been charged with murder in the December shooting death of his wife, Donna Quinlan

HOUSTON (KTRK) -- A man charged in the shooting death of his wife last month reportedly killed himself on Thursday.

The Montgomery County Sheriff's Office says shortly before 10am Thursday they were contacted by security reporting that Thomas A. Quinlan came into the April Sound Subdivision going to his home on North April Waters. Security officers knew of the emergency protective order in place against Quinlan prohibiting him from being at the house.

Quinlan was arrested on December 30, 2012, for the shooting death of his wife, Donna Quinlan.

Deputies say when they arrived Thursday, they learned that no one was in the home other than Quinlan and they could not make contact with him. SWAT deputies entered the home and say they found Quinlan dead of what is believed to be a self-inflicted wound.

Quinlan was released from the Montgomery County Jail on January 3 after posting the $500,000 bond set at the time of his arrest last month.

Deputies say the investigation continues.

Noe Aranda Noe Aranda, 32, is charged with murder and aggravated assault with a deadly weapon.

HOUSTON (KTRK) -- A man has been charged for shooting two women who were then pushed or jumped from a moving car last week on the Katy Freeway. One of those women was killed, the other seriously wounded.

Noe Aranda, 32, is charged with murder and aggravated assault with a deadly weapon. The identity of the deceased 22-year-old victim is pending verification by the Harris County Institute of Forensic Sciences. The surviving victim, 21, remains in stable condition at an area hospital. Aranda shot both women several times.

Police say HPD patrol officers and Harris County Sheriff's Office deputies on October 11 responded to a scene that appeared to be an accident at 24000 Katy Freeway in which a female was struck by several vehicles.

A second woman from the same vehicle was either pushed or jumped from the vehicle in the 24000 block of the Katy Freeway. She was struck by several vehicles and died at the scene.

Aranda, the driver of the Magnum, remains at large. His vehicle was recovered the day of the incident.

Police tell us Aranda is the same man who led police on a high-speed chase with four children in his vehicle back in April. He was charged with assaulting a family member, endangering a child and evading arrest in that case.

Anyone with information on the whereabouts of suspect Noe Aranda is urged to contact the HPD Homicide Division at 713-308-3600 or Crime Stoppers at 713-222-TIPS.

Houston Zoo mourning death of California sea lion

Astro, a four-year-old sea lion at the Houston Zoo, has died. (Houston Zoo) Astro, a four-year-old sea lion at the Houston Zoo, has died. (Houston Zoo)

HOUSTON (KTRK) -- There's sad news to report from the Houston Zoo. A California sea lion who had been there since 2009 after being rescued three times has died.

According to zoo officials, preliminary findings suggest 'Astro,' the four-year-old sea lion living at the Zoo's McGovern Mammal Marina, died from severe gastroenteritis, however a final cause of death won't be known for a few weeks.

"This is a devastating loss for everyone at the Zoo" said Sea Lion Curator Beth Schaefer. "Since his arrival in 2009 Astro had endeared himself to everyone who met him, from Zoo guests to the sea lion keepers. Every Zoo employee held a special place in their hearts for Astro."

Astro was 11 months old when he came to the Houston Zoo back in 2009 from the Long Marine Laboratory in Santa Cruz. Prior to that, he had been found stranded three times off the California coast. Two of those times, he was released back out into the wild, but the third time, marine mammal rescue personnel determined it was necessary to keep him in a controlled environment.

"Astro had a rough beginning, but he found a loving and caring home at the Zoo and quickly won everyone over with his friendly and spirited personality," said Schaefer.

Schaefer says the two female California sea lions, Cali and Kamia, are both in good health.

Fan who fell to death at Texans game at Reliant Stadium was legally drunk

HOUSTON (KTRK) -- We have an update on a story we first told you about last month. A man who fell to his death at a Texans game was legally drunk.

The medical examiner says 25-year-old Jonathan Kelly had a blood alcohol content of .16. That's twice the legal limit.

Kelly fell 60 feet to his death in the Texans final preseason game August 30 at Reliant Stadium. Eyewitnesses say he and some friends were riding the escalators handrails when he lost his balance.

The medical examiner ruled Kelly's death as accidental and says he died of multiple blunt force injuries.

Texas inmate prepares for 3rd trip to death house

LIVINGSTON, TX (KTRK) -- What Cleve Foster remembers most about his recent brushes with death is the steel door, the last one condemned Texas inmates typically walk through before their execution.

"You can't take your eyes off that door," he says.

But twice over the past year and a half, Foster has come within moments of being escorted through the door, only to be told the U.S. Supreme Court had halted his scheduled punishment.

On Tuesday, Foster, 48, is scheduled for yet another trip to the death house for participating in the abduction and slaying of a 30-year-old Sudanese woman, Nyaneur Pal, a decade ago near Fort Worth.

It takes just under an hour to drive west from the Texas Department of Criminal Justice Polunsky Unit, where the state's male death-row inmates are housed, to the Huntsville Unit, where condemned Texas prisoners have been put to death for nearly a century. The last 485 have been by lethal injection; the first 361, from 1924 through 1964, from the electric chair.

On execution day, the condemned inmate waits, usually for about four hours, in a tiny cell a few steps from the steel door to the death chamber.

Foster, a former Army recruiter known to his death row colleagues as "Sarge," denies his role in the murder. Prosecutors say DNA ties him to the killing and that he gave contradictory stories when questioned about Pal's death.

"I did not do it," he insisted recently from a tiny visiting cage outside death row.

Appeals again were pending in the courts, focusing on what his lawyers argued was poor legal help both at his 2004 trial in Fort Worth and by attorneys early in the appeals process. Similar appeals resulted in the three previous reprieves the courts subsequently have lifted, but his lawyers argue his case should get another look because the legal landscape has changed in death penalty cases.

"I don't want to sound vain, but I have confidence in my attorney and confidence in my God," he said. "I can win either way."

Pal's relatives haven't spoken publicly about their experiences of going to the prison to watch Foster die, only to be told the punishment has been delayed. An uncle previously on the witness list didn't return a phone call Friday from The Associated Press.

Foster, however, shared his thoughts of going through the mechanics of facing execution in Texas -- and living to talk about it.

The process shifts into high gear at noon on the scheduled execution day when a four-hour-long visit with friends or relatives ends at the Polunsky Unit outside Livingston.

"That last visit, that's the only thing that bothers me," he said. "The 12 o'clock-hour hits. A dozen or so guards come to escort you."

By Foster's count, it's 111 steps to the prison gate and an area known as the box cage. That's where he's secured to a chair for electronic scrutiny to detect whether he has any metal objects hidden on his body.

It's the legacy of inmate Ponchai Wilkerson. Wilkerson, asked by the warden if he had a final statement after he was strapped to the death chamber gurney for execution in 2000, defiantly spit out a handcuff key he'd concealed in his mouth.

"You're in handcuffs, you're chained at the ankles, they give you cloth shoes and you have to shuffle to keep them on," he said.

As he waddles the 111 steps, he gets acknowledgement from fellow prisoners who tap on the glass of their cells.

At the prison gate, armed officers stand by as he's put in a van and secured to a seat for the roughly 45-mile trip to Huntsville that he says feels like a "90-mph drive." There are no side windows in the back of the van where Foster, accompanied by four officers, rides to the oldest prison in Texas. Only the back doors have windows.

"It's like stepping back in time, dungeons and dragons," he said of entering through two gates at the back of the Huntsville Unit, more commonly known as the Walls Unit because of its 20-foot-high red brick walls.

Prison officials then hustle him into the cell area adjacent to the death chamber.

"Going inside, it's a little spooky. You can tell it's been there a while," he said. "Everything's polished, but still it's real old. You look down the row. History just screams at you.

"It's almost like `Hotel California,"' he said, referring to the song by The Eagles. "You can check out anytime, but you can't leave."

Both times he's been there, most recently last September, he's been treated "like a human being," Foster said. Officers look at him but don't smile, he said.

At one point, he saw someone walk by with a bulging envelope that he assumed contained the lethal injection drugs.

At 4 p.m., during his first trip to the death house in January 2011, he was served a final meal. He'd asked for several items, including chicken.

"It tasted so good," he said. "It actually had seasoning on it."

Two hours later, at the start of a six-hour window when his execution could be carried out, he received the Supreme Court reprieve.

Since then, inmates no longer get to make a final meal request. Procedures were changed after a state lawmaker complained that condemned inmates were taking advantage of the opportunity and that murder victims never get that chance.

Foster was looking forward to nachos and chicken, the same food served to other inmates the day last year that he made his second trip to the death house, but he never received it. Instead, his attorney tearfully brought him news of another Supreme Court reprieve just before dinner time.

He asked for a doggie bag but was refused. He was put back in the van and returned to death row.

"I've already told the chaplain: Take the phone off the hook before 4 o'clock," he said, anticipating his next trip Tuesday. "I want to get that last meal."

Sentencing today for mother convicted in her 4-year-old daughter's death

HOUSTON (KTRK) -- Sentencing begins today for the woman convicted of murder and injury to a child by omission in the death of her four-year-old daughter.

Macial Sandoval was found guilty of allowing her daughter, Betsabeth, to die from abuse and neglect. The little girl was found unconscious last June. Her body had deep cuts, bruises and fractures.

Sandoval faces up to life in prison. Her partner will also go to trial for the child's death.

Emotions high last week

Last week was an emotional roller coaster inside the courtroom. The defense for Sandoval said someone else is to blame. She sat quietly as closing arguments painted vastly different pictures of her role as mother t Betsabeth.

Horacio Ramos is Betsabeth's father.

"Real sad, angry at the same time because I'm still wondering what the jury would do," Ramos said.

On Friday the focus was on Betsabeth's mother. Prosecutors say the little girl was found with numerous bruises, contusions, and other injuries in June 2011.

During her closing arguments on Friday, assistant district attorney Connie Spence told jurors, "Having a child, being a mother, is not a right, it is a privilege granted by God."

Ramos listened to the argument with tears in his eyes.

"Even though it's not going to bring my daughter's life back, I still want them to get the punishment they deserve," said Ramos.

But defense attorneys put the blame on Sandoval's partner, who they say was at home taking care of Betsabeth while Sandoval was away at work.

"She trusted the homemaker to take care of the home. Don't punish someone for being in love," said defense attorneys.

But Ramos says little Betsabeth deserves justice.

"People like that, I don't think they have a heart, to do something like that to their own child," he said.

The defense did not call any witnesses.

In closing arguments, the prosecution stated, "We knew this was going on before June 3rd. The medical examiner said this was going on way before June 3rd."

The defense says Sandoval was simply not aware of what was going on in the home, saying, "The child became increasingly difficult. She didn't know what the cause was."

Crystal KobzaHOUSTON (KTRK) -- Homicide detectives have converged on a northwest Harris County gas station where a man was shot and killed this morning.

We're told that one person is confirmed dead after being shot here in this Shell gas station parking lot. This all happened after an apparent road rage incident.

This shooting happened around 7:15 this morning on FM 1960 and Perry Road. According to family members with whom we spoke, they say their relative got into a minor fender bender and pulled into this gas station parking lot. Deputies believe the now deceased man came up to the window of her Toyota Camry and started beating on it and threatening her. That's when the 23-year-old women, who was on her way to work, pulled out her gun and shot the man.

"She was on her way to work. She works at Chase Bank. This was a normal morning for her headed into work. It's unfortunate her morning did not proceed as planned," said James Dixon, family pastor.

Waller County reports first West Nile-related death

HOUSTON (KTRK) -- Waller County is reporting its first West Nile virus-related death.

Waller County health official Brian Cantrell says the state's health department informed them of the death late Thursday. Right now, all we know is that the person lived in the Hempstead area.

On Thursday, the city of Houston reported its fourth death from the mosquito-borne disease. That victim is a 75- to 84-year-old man from northwest Houston.

On Friday, the Houston Health Department also reported two new human cases, raising the total in Houston to 51.

Harris County also is reporting five new cases, bringing its total to 21. No deaths have been reported in Harris County.

Fort Bend County has reported eight total cases, and Brazoria County is now reporting two probable cases -- one in the northern part of the county, and the other in the central part of it.

As for other counties in our area as of last Friday, Montgomery County has reported four cases with no deaths. Wharton County has had one case with one death. Liberty County and Galveston County have both had one case with zero deaths.

Overall, more than 75 human cases have been confirmed across the ABC13 viewing area with five deaths, the four in Houston and one in El Campo.

Federal health officials say this is the nation's worst year for the mosquito-borne virus since it was discovered in New York 13 years ago.

There are more than 1,400 cases of West Nile in the United States. Texas has at least 52 of the country's 118 West Nile related deaths.

Several Texas counties have been spraying pesticide to help reduce the mosquito population.

Mosquito-proof your property

HCPHES continues to encourage residents to eliminate mosquito breeding habitats around their property. Remove or empty all outside containers that may hold water such as flowerpots, tires and toys. Bird baths and pet water bowls should be changed at least twice a week. Clean out gutters and make sure windows and doors have proper screening. Do not "feed" the storm drains. Sweep up lawn clippings, leaves and tree limbs from sidewalks and driveways and dispose of them properly.

Prevent mosquito breeding in boats Cover your boat and store it in a covered place. Drain any standing water and make sure the bilge pump is working.Turn over canoes, kayaks and small boats to store upside down.

Personal protection

Historically, in Harris County, July through September is the peak timeframe for disease transmission to humans. To reduce the likelihood of being bitten by mosquitoes, practice personal protective measures. When outdoors, use an insect repellent containing the active ingredient DEET, Picaridin, oil of lemon eucalyptus, or IR3535 and apply as directed on the label. If possible, wear long-sleeved shirts and long pants at dawn and dusk when mosquitoes are most active.

For additional information and/or maps of West Nile Virus activity in Harris County, visit www.hcphes.org.

Jury finds mother guilty of felony murder and injury by omission in death of 4-year-old girl

Mother on trial for death of 4-year-old girl

By Pooja LodhiaHOUSTON (KTRK) -- Disturbing testimony and graphic pictures took center stage Thursday in the trial of a mother accused of allowing her young daughter to die from abuse and neglect.

Little Betsabeth Sandoval was just four years old when police found her unconscious last June, her body showing deep cuts, bruises and fractures. On Thursday her mother was forced to hear prosecutors describe how her child died while they say she did nothing about it.

In a dramatic demonstration, the prosecutor wrapped a t-shirt around a stick and showed the court how she says four-year-old Betsabeth died. The girl's mother, Maciel Sandoval, sat in the courtroom in tears as prosecutors showed photos of the injuries.

The assistant medical examiner testified, "It's not just a bruise on the outside of the skin. It's substantial damage in the connected tissues underneath the skin. For that reason it's not consistent with a simple fall from a standing position."

Police say they found the little girl unconscious and hurt at her home last June.

Police say Sandoval denied responsibility saying, "Defendant Sandoval stated that the complainant was very accident prone, fell often, and was also a very angry four-year-old."

Both Sandoval and her partner have been charged with injury to a child by omission. Prosecutors haven't accused either woman of actually attacking the child.

"They don't want to have to prove who did it because they're both going to point the fingers at each other and say you did it or somebody else did it," KTRK legal analyst Joel Androphy explained. "To avoid the finder pointing, they say, basically, we don't care who did it. You had a responsibility and duty under law to protect that child and you didn't."

Androphy says the penalty is the same for physically abusing your child and allowing abuse to happen.

"The law doesn't differentiate because you have a vulnerable young child," he said. "This is a very difficult case, one of the most difficult cases to try."

The defense rested without calling any witnesses. Closing arguments are expected to be heard Friday morning. If the mother is found guilty, she could face up to 99 years in prison.

After this trial, Sandoval's partner is expected to go to trial.
