Murder suspect fires at HPD, leads police on chase

  HOUSTON (KTRK) -- A man accused of murdering a woman and then shooting at a Houston police officer was arrested Sunday morning after leading police on a chase.

It all started around 7:15am at a Connie Leatrice Bowie's home in the 4100 block of Brisbane near Roandale.

Investigators were called there for an assult in progress. According to police, there was a domestic dispute between the homeowner and the 43-year-old suspect, Herbert G. Gardner.

When the first officer arrived at the scene, Gardner reportedly sprayed the officer's cruiser with a shotgun. The officer was not hit and Gardner fled in a red Dodge Nitro.

Police say they found Bowie's body in her home on Brisbane. The 39-year-old was shot to death.

Officers chased Gardner for about 20 minutes, exchanging gunfire, but no one was hit. The man eventually stopped at a home in the 5300 block of Glen Rio where he pointed a gun at officers again before he was subdued and arrested.

He was taken to an area hospital for treatment of minor injuries.

Police said Gardner once dated Bowie and lived at the home on Brisbane with her, but he had recently moved out and they were arguing.

Police expect Gardner to face charges of murder, attempted capital murder of a police officer and possibly aggravated assault of a police officer.

Murder suspect accused of firing at HPD in custody

  HOUSTON (KTRK) -- Authorities say a 43-year-old man is now in custody after firing at officers. He also led them on a chase that began at a home where a body was found.

Yesterday morning, a police officer responded to an assault call near south Houston when he was immediately fired upon entering the neighborhood.

The shooter got into a vehicle and tried to flee the scene. Police chased the suspect until he attempted to break into a nearby home.

Police say the body of a women was found on the porch who neighbors identified as the shooters ex-girlfriend. Charges have not yet been filed against the shooter.

Man charged with murder in west Harris Co. arrested

  HOUSTON (KTRK) -- A man has been arrested, accused of killing another man in west Harris County earlier this month.

Yusef Villanueva was arrested at his home Wednesday. He's charged in the murder of Juan Reyna, 16. According to investigators, Reyna went to Villanueva's home on December 11.

Once inside, the two reportedly got into an argument. During that argument, deputies say Villanueva fired a shotgun one time, hitting Reyna once in the pelvis.

Reyna was transported to Memorial Hermann Hospital, where he died during surgery.

Deputies: Kids found near drugs, guns after murder

  CONROE, TX (KTRK) -- A Conroe couple is facing charges after a neighbor was shot to death, and their young children were allegedly found near guns and drugs.

Montgomery County Sheriff's Office deputies were called to a home in the 16900 block of West Hammon, just west of Conroe around 5pm Thursday. Deputies arrived found Marcus "Dale" Fisher, 51, had been shot and killed, reportedly by a neighbor. Jaime Ryan Devita, 33, was arrested at the shooting scene for murder.

Deputies say Fisher arrived on his motorcycle at a nearby residence of Devita to visit friends. Fisher was reportedly confronted in the street by Devita, and during an argument was hit with a fatal shotgun blast to the chest.

Witnesses told deputies that Devita's wife and children had been seen just before the shooting, but now could not be found. When deputies entered the Devitas' home, they found the wife and children hiding. Inside the residence deputies say they discovered an indoor marijuana grow operation and guns within easy reach of the children, ages two and four.

April Nicole Devita, 30, was arrested and taken to jail for endangering a child. The children were released to Children's Protective Services.

The investigation continued into the night by crime scene, homicide and narcotic investigators. Additional charges are possible.

Pre-trial motion hearing for day care owner Jessica Tata accused of murder

  Pooja LodhiaHOUSTON (KTRK) -- A year after a horrific fire at an in-home day care, a woman accused of leaving very young and helpless kids alone is about to go on trial for murder. But first, critical decisions will be made about what evidence can be used against her.

Four small children were killed in February of last year when a fire broke out at a home day care in west Houston. Jessica Tata, the woman who was supposed to be watching them now faces murder charges.

On Monday she was in court as attorneys argued about what evidence should and should not be allowed in her upcoming trial.

Jessica Tata sat in the courtroom staring straight ahead. The now 24-year-old is charged with four felony murders, the first of which goes to trial next week.

"She's diabetic and we're dealing with that. My son went to get her an order for insulin. But other than that, she's doing as best she can in the situation she's in," said defense attorney Mike DeGuerin.

Prosecutors allege that on February 24, 2011 Tata went shopping when she was supposed to be watching several children at her home day care. Police say she left a pot of oil burning on an electric stove and while she was gone, the home burst into flames, killing four young children and injuring three.

Police say Tata then fled to Nigeria to avoid charges. She was arrested and retuned to the U.S. about a month later.

"People have an emotional reaction without knowing all the facts. That's the hardest thing," DeGuerin said.

In Monday's pretrial hearing, attorneys argued over allowing into trial certain evidence and testimony that was collected before Tata was charged. One big issue is Tata's computer and diary. Her landlord gave them to investigators without a search warrant after the fire. Investigators testified they didn't even consider Tata as a suspect when they first questioned her.

"Both sides have a different spin on it. The state says we didn't know she was a suspect. We just needed to know what was going on. The defense saying you knew very well that she was a suspect and would be the target of your investigation," said KTRK Legal Analyst Joel Androphy.

The hearing will resume on Wednesday morning.

A jury panel will fill out questionnaires later this week. Testimony in Tata's trial is set to begin October 24. The trial is expected to last one month.

  HOUSTON (KTRK) -- Two men accused in a minister's murder were in court on Thursday.

Devonte Hayes, 18, and Kesley Davis, 19, went before a judge facing charges in the death of Desmond Jones back in July. Authorities say Hayes and Kesley shot and killed the 21-year-old minister in front of his apartment complex, then stole his vehicle.

Hayes has been charged with capital murder. Kesley is also facing a murder charge.

Man accused of beating woman to death with bat charged with murder, sought by police

Edgar Gonzalez Zavala Edgar Gonzalez Zavala, 40, is charged with murder.

  HOUSTON (KTRK) -- Houston police need your help to find a man accused of beating a woman to death back in July.

Investigators say 42-year-old April Boggs was raped and then beaten to death with a baseball bat. Jewelry, cash, and her car were taken from her home in the 200 block of W. 18th Street. Police responded to a welfare check call after neighbors reported a foul odor emanating from the residence and they found Boggs dead body on the kitchen floor.

Her landlord told police Boggs recently kicked out Edgar Gonzalez Zavala who had been staying with her.

Zavala was arrested in her car for suspicion of DWI in Colorado County, Texas, the same day of the murder on July 29, but officers there didn't know about it. He was released on bond.

A bloody baseball bat and jewelry were found in that car. DNA tests later linked Zavala to the murder.

Zavala, 45, is charged with murder.

Murder suspect at large, charged in fatal club shooting

  HOUSTON (KTRK) -- Houston police have charged a suspect in a fatal shooting that happened at a northeast Houston night club earlier this month, but they need your help to track him down.

Harold Brown, also known as "Scooby," is charged with capital murder. He is accused of fatally shooting three men and wounding three women September 2 at Club I.C.U. on Mesa Road.

Two male victims, 38-year-old Gilbert Kibble and 22-year-old Curtis Steward were pronounced dead at the scene. The third man, 26-year-old Felipe Castillo was transported to Ben Taub General Hospital where he was pronounced dead.

All six victims suffered multiple gunshot wounds. The three women who were hit had non-life-threatening injuries, officials said.

According to witnesses, two women had an argument inside the club and it spilled into the parking lot. Moments later, a large fight broke out.

Police say that's when Brown, 31, pulled out a gun and began shooting into the crowd.

Suspect charged with murder in deadly bar fight

  MONTGOMERY COUNTY, TX (KTRK) -- A man was killed early Saturday after intervening in a fight at a Montgomery County night club.

It happened around 12:45am at the Good Fortune Club in the 25100 block of Interstate 45 North in south Montgomery County.

When Montgomery County Sheriff's Office deputies arrived, they found Christopher A. Dillon dead inside the club and several witnesses blaming the same person for his death -- 30-year-old Toriano Renauld Freeman.

According to witnesses, Freeman entered the club sometime after midnight and asked a customer to use his cell phone. The patron allowed Freeman to use his phone, but then he did not want to return it.

Deputies said a fight broke out and Dillon intervened. Freeman reportedly assaulted Dillon, punching him several times. Witnesses told deputies the victim fell to the floor unconscious and died.

Freeman fled the scene on foot. He was arrested around 10:30am at a convenience store at the intersection of Sawdust Road and I-45, near where deputies believed he lives.

Officials said Freeman was charged with murder. He was also wanted for an outstanding misdemeanor theft warrant.

  HOUSTON (KTRK) -- Crime Stoppers and investigators with the Houston Police Department are searching for the suspect responsible for the 2005 murder of Nick Munoz and Chaz Kettner. Yesterday marked the seventh anniversary of Nick Munoz' and Chaz Kettner's deaths and today would have celebrated Kettner's 28th birthday.

It has been seven years since 20-year-olds Nick Munoz and Chaz Kettner were gunned down at an area gas station. It was Tuesday, September 13, 2005, at approximately 10:35 pm, when Kettner and Munoz were approached by an unidentified black male while seated in their vehicle at a gas station located on the 2700 block of W. Sam Houston Parkway. The unknown suspect shot both of the victims while they were in the vehicle.

Kettner died where he was seated. Munoz attempted to flee, but collapsed, passing away near the door of the service station. The unknown suspect fled the scene in a green truck.

Jury finds mother guilty of felony murder and injury by omission in death of 4-year-old girl

HOUSTON (KTRK) -- A Harris County jury has found a mother guilty of felony murder and injury by omission in the death of her 4-year-old girl.

The punishment phase will begin on Monday. Macial Sandoval will face up anywhere from five years to 99 years in prison for the death of her daughter, Betsabeth.

All this week, it's been an emotional roller coaster inside the courtroom. The defense for Sandoval says someone else is to blame. She sat quietly as closing arguments painted vastly different pictures of her role as mother to little Betsabeth Sandoval. The 4-year-old died last June.

Horacio Ramos is Betsabeth's father.

"Real sad, angry at the same time because I'm still wondering what the jury would do," Ramos said.

On Friday the focus was on Betsabeth's mother. Prosecutors say the little girl was found with numerous bruises, contusions, and other injuries in June 2011.

During her closing arguments on Friday, assistant district attorney Connie Spence told jurors, "Having a child, being a mother, is not a right, it is a privilege granted by God."

Ramos listened to the argument with tears in his eyes.

"Even though it's not going to bring my daughter's life back, I still want them to get the punishment they deserve," said Ramos.

But defense attorneys put the blame on Sandoval's partner, who they say was at home taking care of Betsabeth while Sandoval was away at work.

"She trusted the homemaker to take care of the home. Don't punish someone for being in love," said defense attorneys.

But Ramos says little Betsabeth deserves justice.

"People like that, I don't think they have a heart, to do something like that to their own child," he said.

The defense did not call any witnesses.

In closing arguments, the prosecution stated, "We knew this was going on before June 3rd. The medical examiner said this was going on way before June 3rd."

The defense says Sandoval was simply not aware of what was going on in the home, saying, "The child became increasingly difficult. She didn't know what the cause was."

Sandoval's partner is facing the same charges, and will face trial at a later date.

Murder convict's lawyer calls DA's office 'schizophrenic'

HOUSTON (KTRK) -- A convicted killer's legal team convinced a judge Wednesday to listen to new evidence, and weeks ago convinced the Harris County district attorney to hire a special prosecutor.

With those two wins in their pocket, David Temple's legal team now wants the DA's office thrown off the rest of the case entirely. It's the latest move in an effort to get Temple out of prison after he was convicted of murdering his wife, Belinda.

This, by now, is a 13 and a half year old murder case. But the alleged new evidence was apparently just discovered this summer. And on Wednesday, the defense team called the DA's office "schizophrenic" and tried to convince a judge to move the DA's office and all its case knowledge off the case.

For convicted killer David Temple's family this is about one thing -- "Freedom," as Temple's mother said as the elevator door closed.

"David Temple has been in prison for five years and he's an innocent man," said Dick DeGuerin, Temple's lawyer.

That's not what a jury said five years ago. And it's not what Belinda Temple's still grieving brother says now. We reached him by phone from north Texas.

"David Temple was found guilty and he needs to stay in the penitentiary for the rest of his life," Brian Lucas told us.

But Dick DeGuerin wants David Temple out now, and he's closer to that wish now than he's ever been. DeGuerin, Temple's original defense lawyer, assembled a team for this latest appeal that includes a former Harris County homicide chief who took the new evidence to an old colleague at the DA's office. Weeks later, the DA agreed to hire a special prosecutor. According to two DA sources, this is the first time DA Pat Lykos has ever done that during her four years in office.

"My role is as an outside, if you will, investigator," said special prosecutor Brad Beers.

And while that special prosecutor investigates the alleged new evidence and possibly charges two teenage burglary suspects with murder, DeGuerin Wednesday asked a judge to order the entire DA's office off the case, saying it can no longer be impartial. DeGuerin's team though would still be allowed to talk to the special prosecutor.

"I think the special prosecutor becomes an arm of the defense team," said Paul Doyle, Temple's lawyer.

The judge didn't rule on DeGuerin's request. All this is very different from virtually every other murder case ever tried in this courthouse. And this new path leaves the victim's family feeling trapped.

"I wish some day this would all just go away, this would end for the family. But I don't think it ever will," Brian Lucas said via phone.

The DA's office issued a statement late Wednesday afternoon saying it is handling the case appropriately. They're standing behind the conviction in the appeals courts while at the same time employing that special prosecutor to question it. Dick DeGuerin calls it "schizophrenic." In their statement, the DA's office calls it the right thing to establish the truth.

Ex-prosecutor responds to new allegations of misconduct in football coach's murder conviction

HOUSTON (KTRK) -- Kelly Siegler had a reputation as a tough prosecutor, but defense attorneys say she broke the rules and now an innocent man is in prison.

Attorneys for a former Katy football coach convicted of murdering his wife are accusing the former Harris County prosecutor of hiding evidence. Now that former prosecutor is speaking out as David Temple demands a new trial.

This is part of a rough and tumble courthouse maneuver to get a convicted killer out of prison. The allegations of prosecutorial misconduct have been raised before and the prosecutor has come out clean. The prosecutor tells Eyewitness News she didn't hide anything and she says some of the alleged new evidence is made up by defense attorneys.

David Temple has been in prison nearly five years.

"Find the defendant, David Mark Temple, guilty of murder," read the judge at the time.

In November 2007, a jury convicted the 44-year-old father of killing his pregnant wife, Belinda. On Tuesday, Temple's lawyers were back in court claiming Temple is innocent and demanding another trial.

"We're gonna be back tomorrow," said Dick DeGuerin, Temple's lawyer.

This is their fifth attempt at an appeal on a case DeGuerin can't or won't let go of. This, after the first appeal in 2008.

"I made a pledge to David Temple that I will never give up," DeGuerin said back on January 14, 2008.

Temple's legal team says now, as they've said in the past, that prosecutor Kelly Siegler was too aggressive in her prosecution of Temple and hid evidence key to his defense.

"I am always aggressive, but as far as withholding evidence, exculpatory information, Brady evidence, that did not happen," Siegler told us.

The defense claims to have uncovered new evidence pointing to an old suspect -- Riley Joe Sanders, Temple's teenage neighbor. The defense says a witness came forward this summer saying, "Sanders admitted committing the burglary of the Temple home on January 11, 1999, and admitted to shooting his shotgun during the burglary."

Sanders testified in the first trial and the jury still convicted David Temple, but the defense now says they "did not know that (a) detective told a grand jury that Sanders was one of two suspects in the murder investigation... the other suspect was Temple."

"It didn't happen," Siegler said.

Now David Temple is in prison for life. Siegler has since retired from the DA's office. The teenage suspect has a new lawyer and new allegations to fight. And a case that was supposed to be settled by a jury verdict five years ago, isn't even close to settled.

"There were hundreds of little pieces of evidence that pointed toward one person and one person only, and that's David Temple," Siegler said.

On Wednesday morning, Temple's lawyers will lay out their new evidence to the judge who will eventually decide on the new trial.

At the same time, we're told the investigator working with the DA's special prosecutor has already sought to question suspects implicated by the new evidence. Suspects Siegler says were cleared years ago.

MMA fighter arrested in Galveston on murder charge

  GALVESTON, TX (KTRK) -- An MMA fighter has been arrested and charged with murder following an 11-month investigation, say police.

Ralph "Plexin Texan" Garcia, Jr., was arrested without incident on a murder charge Wednesday. He was taken into custody while training at the Combat Sports Institute in Galveston.

The charges stem from an incident last October 13. The victim, 28-year-old Maxie Flowers, was fatally shot while riding his bicycle early in the morning in the 5400 block of Avenue L. Police believe he had some type of verbal altercation wtih Garcia, Jr., before the shooting.

The investigation is ongoing and police say there could be more charges. Garcia, Jr. is being held in the Galveston County Jail on a $500,000 bond.

Mother faces murder charges in baby daughter's death

  CUT AND SHOOT, TX (KTRK) -- A mother accused of being drunk during a car crash that killed her baby is now charged with murder.

Ashli Heil, 28, was initially charged with intoxication manslaughter for the April accident in Cut and Shoot. Prosecutors say Heil was legally intoxicated, speeding, lost control and crashed her SUV into a tree, instantly killing her 8-month-old daughter.

Heil is now charged with first degree felony murder, which carries a possible life sentence if she's convicted.

Prosecutor Warren Diepraam says he hopes the seriousness of the charge sends a message that the Montgomery County District Attorney's office takes crimes against children seriously because children are truly innocent victims, deserving of our strongest protection.

Young father's murder remains unsolved

HOUSTON (KTRK) -- A Houston man was gunned down after he responded to a knock at the door. Months after the murder near Midtown, his killer remains on the loose.

This crime happened at a home on Cleburne, near Dowling, not far from midtown, at about 7:30 in the evening on Saturday, February 25. The victim, 22-year old Jeremy Perry, answered the door and was shot multiple times.

Houston police investigators do not have a motive or any suspects at this time. They are in need of information. Perry's family says Jeremy was an architectural engineering student at HCC, and leaves behind a three-year-old daughter.

Jeremy's mother Sandra Perry said, "We really feel like Jeremy's story is a special one because he really didn't deserve what basically happened to him. It is such a travesty. If anyone knows anything, if they basically saw anything, it would be neat for them to just call Crime Stoppers."

Jeremy was an organ donor, donating four life-saving organs, which has helped the family deal with the loss, but of course, they want to see the case solved.

Man thrice convicted of DWI facing murder charge

  HOUSTON (KTRK) -- A man convicted of three DWIs in the last three decades now faces felony murder charges in a crash that killed his passenger.

Investigators believe 64-year-old Casmiro Campos was drunk when he crashed into the wall of a convenience store. It all happened Wednesday afternoon at South Post Oak and Anderson. Amelia Perez, 46, was ejected from his SUV and died later at the hospital.

Campos has been convicted of previous DWIs in 1985, 1987 and 1993.

Capital murder charge filed in deadly 2008 robbery

  HOUSTON (KTRK) -- Detectives have filed a capital murder charge against a man accused in the fatal shooting a tow truck driver during a 2008 robbery in southwest Houston.

Police say Cesar Velasquez-Jaime acted as the getaway driver during a September 28, 2008 robbery that ended with the death of Mario Jove, a tow truck driver.

Detectives believe Velasquez-Jaime and Edgar Padron followed Jove from a tow yard to a an apartment complex in the 7000 block of Hillcroft with the intention of robbing him. The duo confronted Jove in the parking lot and started fighting over his digital camera and wallet.

According to court documents, Padron shot Jove four times and then hopped into a Ford Mustang driven by Cesar Velasquez-Jaime.

Witnesses later identified Velasquez-Jaime and Padron as the suspects.

Padron was charged with capital murder in June 2011. He is also awaiting trial on a separate capital murder charge for the fatal shooting of Saturnino Argueta during an attempted robbery on New Year's Eve in 2010. He was indicted in that case in April 2011.

Murder suspect who forced lockdown of four Houston area schools earlier this month arrested in Virginia

  HOUSTON (KTRK) -- We have an update on the search for a murder suspect who forced the lockdown of four schools earlier this month.

On Wednesday, police in Virginia arrested Zumbotha Newsome. Deputies have been searching for Newsome in connection to a deadly road rage incident in April. He disappeared in north Harris County earlier this month.

Four Klein ISD schools were locked down as deputies searched an area where he was possibly sighted.

It's not yet clear when he will be transferred from Virginia to Texas.

Stripper 'Pocahontas' arrested on capital murder charge in man's shooting death

  HOUSTON (KTRK) -- Police have arrested a stripper named "Pocahontas" in a capital murder investigation.

Luerissie Ross was arrested Tuesday morning in Katy. Police say Ross confessed to helping arrange the robbery and fatal shooting of a man in February. Officers say two friends of Ross fatally wounded Budrohoe Briscoe during the robbery. He died about two weeks later.

"We know there is another case. In that case, the victim has not chosen to cooperate with us, so we believe that others exist; others may feel uncomfortable or embarrassed about coming forward," said C.P. Abbey with HPD Homicide Division.

Besides Ross, officers have arrested another person in this case and have a third person of interest.

Ross, 20, is charged with capital murder.
