  HOUSTON (KTRK) -- Some middle school students have a shortened school day today due to a power outage.

According to a Spring ISD spokesperson, Dueitt Middle School released students early due to the outage. A fire alarm went off this morning before school started. It was prompted by smoke from air conditioning equipment that overheated due to the failure of the a nearby transformer.

Staff and students who were already at school were evacuated and students who were arriving at school were kept outside the building.

Centerpoint is working on the problem and hope to have it resolved by the end of the day.

Spring middle school teacher pleads guilty to sexually assaulting student

Andre Levelle Thomas, 32, is charged with aggravated sexual assault of a child. Andre Levelle Thomas, 32, is charged with aggravated sexual assault of a child.

  HOUSTON (KTRK) -- A Spring ISD teacher has pleaded guilty to sexually assaulting a student.

Andre Thomas was a teacher at Roberson Middle School, when he raped a 13-year-old girl in his classroom in August of last year. On Tuesday, Thomas made a plea agreement and was sentenced to 180 days in jail and ten years probation.

A statement by the victim was made in court Tuesday. In it, she said she had to pretend Thomas was a good teacher, when he was really a horrible teacher, but she said she is a survivor.

Chicken fight brewing in Spring neighborhood

HOUSTON (KTRK) -- A showdown in one Spring neighborhood is ruffling a lot of feathers. It's a dispute over chickens and whether one man has the right to keep them in his backyard.

For Joshua Mouzakis, the 25 to 30 chickens and five roosters he's raising in the backyard of his Spring home are more than just a food source for his family; he calls them pets.

"They've all been raised by my daughter over here, at the other coop over there. Since they've been chicks, they've been running around with her, they all run to here and flock to her," said Mouzakis.

He says he's had poultry at his home for years with no problems until just recently when he was contacted by the Harris County Attorney's office after a neighbor complained about the noise and the smell.

"The neighbors behind me here don't like the roosters crowing, and I understand that and I offered to put up a privacy wall in the back here at my expense, at no expense to them at all, and that was unacceptable for them," Mouzakis said.

The County Attorney's office says Mouzakis is violating his neighborhood deed restriction.

"It says no obnoxious or offensive activities shall be carried on or upon any part of this track," said Randy Smidt with the Harris Co. Attorney's office. "We're really talking about the smells and the noises and those become a nuisance to those who complain about them."

In addition, the county says the deed restriction prohibits breeding.

"There was hens, there was babies, there was four roosters and they were all together, and so from our perspective, it's hard to believe they are not being bred," said Smidt.

Mouzakis insists he is trying to be a good neighbor and believes he's not in violation by having what he calls his family pets around. But he is willing to comply with the county's demands.

The county is asking Mouzakis to get rid of all the roosters to avoid the noise and he must also get rid of most of the chickens. They say, however, that he can still have some chickens as pets for the family.

Spring woman accused of trying to pin blame for serious car accident on ex-husband

  HOUSTON (KTRK) -- A Spring woman is accused of attempting to pin a serious car accident on her ex-husband who was actually working at the time.

According to court documents, on March 8 a driver was seriously injured when a dark colored Ford F-150 struck her vehicle in the 200 block of Cypresswood Dr. in north Harris County. The victim says the driver fled the scene without stopping.

Detectives say they found the license plate in the debris and traced it to a Matthew Wallace. Further investigation revealed that the license had been canceled and a new plate had been issued on March 23, and that the vehicle was involved in another accident on April 22.

Court documents state investigators went to the address listed with the new license plate and observed a Ford F-150 bearing the new plate with front-end damage consistent with the Cypresswood crash.

Investigators interviewed the complainant in both reports, Brenna Nicole Wallace. They say she told them that she drove the truck to a night club where she met her ex-husband, Matthew Wallace, and that they were both intoxicated and left the club in her truck. According to investigators, Brenna Wallace said Matthew Wallace was the driver of the vehicle that night and that he was involved in the accident. They say she admitted to getting new license plates for the truck after the accident.

Court records show that investigators interviewed Matthew Wallace who provided copies of work time sheets that show he was working at the time of the accident. He also provided a copy of his divorce decree which awarded the truck to Brenna Wallace. Investigators say Matthew Wallace showed them a picture that Brenna Wallace texted to him the day of the accident saying she was involved in an accident and showing the damage, and asking him for advice.

Brenna Wallace, 31, is charged with failure to stop and render aid. Bond has been set at $5,000.

Special Olympians compete in Spring Games in Humble

See it on TV? Check here.   HOUSTON (KTRK) -- Local athletes are counting their medals from the annual Spring Games competition of the Special Olympics of Texas.

The event was held at Humble ISD's George Turner Stadium Saturday. The games started with opening ceremonies, then a full day of competition in track and field events and soccer.

Forty-four thousands children and adults with intellectual disabilities compete in Special Olympics Texas.

Wilbur the pig wins his battle versus homeowners association in Spring

HOUSTON (KTRK) -- Big developments in one family's fight over a pet pig named Wilbur. The family has been in a court battle with their homeowners association over whether the pig stays or goes.

Thousands of people have showed their support for the family on Wilbur's Facebook page, and today a judge made the official decision.

Two words: Wilbur won. Not a huge court case with millions of dollars on the line, but for a Spring family, the stakes couldn't have been higher.

Wilbur is a pot-bellied pig that the Sardo family has had for a year and a half since Wilbur was a 7-week-old piglet. They live in a Spring subdivision and Wilbur is primarily a house pet. When the homeowners association was told there was a pig in the neighborhood, the Sardos were told to get rid of him or face a lawsuit and a huge fine.

Instead, the Sardos sued, claiming that Wilbur was not livestock, but a pet.

In court Monday, the HOA argued a pig is a pig and while not specifically named in the deed restrictions, it's not your ordinary house pet.

At the end of the hearing Monday afternoon, the judge ruled that while the purpose of a homeowners association is to preserve the appearance of a neighborhood, it can also overstep its bounds. He then ruled that Wilbur can stay where he lives -- mostly indoors -- with his family and a dog.

The Sardos couldn't be happier -- even crying as they left the courtroom -- ending a year-long battle with their HOA.

"Relief, when he said that. And he has his web page and he has the most unbelievable supporters and I thank all of you out there," said Missy Sardo, Wilbur's owner.

The homeowners association attorney left without comment. But at one house in Spring, there is much celebrating.

Spring Valley Village police urge residents to be on alert after two burglaries in the area

  HOUSTON (KTRK) -- Authorities in Spring Valley Village are urging residents to be on alert after two burglaries in the area.

On March 15, Spring Valley Village police say between 11:15am and 11:45am, officers responded to two residential alarms within minutes of each other, one at a residence in the 8400 block of Winningham Lane and the other at a residence in the 1400 block of Cedarbrook Drive.

Upon arrival in both cases, officers found that an unknown suspect or suspects had forced entry into the residences.

In one case, it does not appear that any items were taken. In the other incident, valuables were removed from the home.

In the incident on Winningham Lane, police say a witness observed a vehicle parked in front of the residence shortly prior to the police department responding to the alarm. She described the vehicle as an older model Dodge mini-van, dark blue in color. She also stated she observed a male driver in the vehicle and a second male walking from the residence to the vehicle.

Authorities encourage you to immediately report any unusual or suspicious activity to the police department.

Spring man arrested in MO for theft of a military bus

See it on TV? Check here. AP  CONWAY, MO -- Authorities have arrested a 22-year-old Texas man suspected of driving a military bus stolen from Springfield, Missouri.

The Lebanon Daily Record reports that Tom Mourning of Spring, Texas was charged Friday in Missouri's Laclede County with one count of first-degree tampering with a motor vehicle.

It all started Thursday when the Conway Police Department was called to a restaurant where Mourning had trouble paying his $13.86 bill because his credit cards were declined. Police said he had been "very unruly and disorderly" to waitresses and many customers.

An officer escorted Mourning to his motel room, and Mourning allegedly tried to go in the bathroom and shut the door to keep the officer out.

Mourning was being held on $25,000 bond on Saturday.

Spring ISD expected to increase taxes

See it on TV? Check here. SPRING, TX (KTRK) -- A big property tax hike could be coming for those living in the Spring Independent School District. Like districts all across the state, Spring ISD is hurting for money. Now, those who live in its borders could wind up paying more on their property taxes.

It's a tough situation, as the school district is getting less money from the state, and as some property values in the area are declining. Put those two factors together, and it means residents are having to pay out more money.

The Ortega family grew up in the Spring school district. But Jennette Ortega isn't sure that her daughter is getting a better education than she did.

She said, "I actually went to Spring, and my brother did as well, and we've always had transportation no matter where we've lived. Now my daughter is the next generation in Spring, and now we're not sure if she'll have the bus transportation."

Spring ISD is cutting bus service to all students living within two miles. But that's not the biggest budget surprise. Homeowners are just beginning to find out that their tax rate is expected to increase 11 cents per $100 valuation.

Spring ISD homeowner Herb Baker said, "I definitely am against it. I think most of the taxpayers out here will be against it."

But Spring ISD, like school districts across the state, says it had little choice. The Republican-controlled legislature slashed $4 billion from public education funding during its most recent session and local school districts must make up the shortfall.

"School finance doesn't look like it's going to get any easier," said Spring ISD spokesperson Karen Garrison. "I would suggest that parents contact their legislators and talk to them, let them know their concerns about the impact."

The school district says the 11 cents tax hike is just an estimate, and that final tax rates won't be set until this fall.

Ortega would like to know why she's paying more for less.

"It doesn't make me happy that I'm going to pay them more and yet they're going to take away the busing," Ortega said.

School bus transportation is not the only item that's expected to change for Spring ISD and school districts across the state. When students return to school this fall, classroom sizes are expected to be larger in the wake of eliminated teaching positions.

Wildfires burn in Spring, Waller

See it on TV? Check here.  HOUSTON (KTRK) -- Two separate wildfires burned across our area on Friday. Both threatened homes, and at least one led to evacuations.

Fire threatens homes in Spring

In Spring, officials evacuated about 200 homes in the Breckenridge Forest subdivision due to a wildfire near Cypresswood Drive and Aldine Westfield Road. Residents were allowed to return to their homes around 5:30pm.

Texas Forest Service helicopters dropped fire retardant in the area all afternoon, but authorities say it was air drops from two C-130 planes that really kept the flames from spreading.

At one point, 60-foot fire walls were within 200 yards of homes. "The fire crews have gone back in with the grass trucks and the brush trucks, the air operations are going on, the dozers are still out in the field doing those fire breaks. So that will continue on through the night until we make sure that this fire is not going to spread anymore," said Lt. Dean Hensley of the Harris County Fire Marshal's Office. As many as a dozen fire departments were on the scene, and many crews were told to pull back. When the flames neared homes, residents were asked to evacuate.

Authorities drove through a section of the Breckenridge Forest subdivision, advising families in about 200 homes that it was time to get out. Gloria Marshall Elementary was among the structures threatened.

Chief Scott Schoonover of the Spring Volunteer Fire Department said the evacuations were precautionary in the event fire got past the fire line. Schoonover said the area is private property and a witness told them that about a year ago, the property was cleared and there's a lot of timber that has been cut down in the area. The chief said that downed timber helped speed the rate of the fire growth.

"Initially, it was about 15 acres when I got here, and it spread throughought the day; the heat, the drought conditions have really hampered operations," Harris County Fire Marshal's Office Lt. Dean Hensley said.

Bulldozers dug out fire lines to contain the blaze. Even though the fire was contained, still resident Adam Rodriquez was uneasy. "We don't know if it's been turned off, has it been contained, we don't know if it will ignite again or if we should stay here," he said. Investigators aren't sure how Friday's fire started, but the Harris County Fire Marshal's Office is investigating. A few minor injuries occurred, but those injured were treated and released on the scene, said Chief Schoonover. Meanwhile, firefighters took on a large wildfire near Highway 290 and FM 2920 near Kickapoo in Waller.

Firefighters from five companies rushed to contain the fire that came dangerously close to several pastures and homes. Many families and the SPCA rushed in to save their livestock. "We called them out of the woods, gave them hay and cubes and tried to contain them right here so they don't get too close to the fire," neighbor Betty Schroeder said. That fire quickly spread across 75 acres. Investigators say the wind and dry conditions were too much to handle at times. They say the good news no homes were destroyed and no people or animals were hurt. However, the Harris County Sheriff's Office says some lanes of FM 2920 near Hwy 290 were closed due to smoke, and traffic was detoured away from the area.

The cause of this fire is still being investigated.

Massive fire burns at facility near Old Town Spring

  DEMOND FERNANDEZSPRING, TX (KTRK) -- A few fire fighters were injured, people evacuated from their homes, some structures destroyed and hundreds left without water all because of a fire eyewitnesses say may have been start by two teens.

It started burning Friday afternoon around Aldine Westfield near Bayer, not far from Old Town Spring. By Friday night, firefighters were still keeping an eye on hot spots. Neighbors say they're upset it's all because a couple of teenagers may have taken a prank with matches way too far. It was an intense fire. "Man, smoke was everywhere," neighbor Tracy Karge said. And neighbors watched as the heavy smoke and flames quickly spread across the old Bayer Lumber Yard and dangerously close to homes. "It's pretty crazy. I've never seen anything like this or a fire like this around this area ever," neighbor Joshua Gorsett said. Some eyewitnesses are telling police they saw a couple of suspicious looking teens running from a hay barn as the fire started. "He saw a couple of kids. They ran out of the barn over there and went back over yonder somewhere, I guess where they live," Karge said. The fire got out of hand fast, burning at least eight acres. And the emergency workers had a tough time containing it. "With the wind and the dry conditions, initially before we got here, it already spread and even once we got there, it jumped over us a few times," said Scott Schoonover with the Spring Fire Department. It took about 100 firefighters from nine agencies to knock out the flames. Two of them had to be treated on scene for heat exhaustion. We also found out 900 people nearby were without water since the fire affected water tanks on the property which serves those homes. "With the dryness that we have and the people that live out here and the homes that are being lost and just livestock that's just out here in this part of Spring, just the sadness that's going on with everything else," Realtor Kevin Reynolds said. "It's just the last thing we need with everything that we've seen happening with our economy and this heat wave and the storms, it's just another added loss to somebody." Students in Spring, Dickinson ISDs in class today

  HOUSTON (KTRK) -- Students in Spring ISD and Dickinson ISD will be in class today.

Those districts scheduled Memorial Day as a makeup day if classes are canceled during the school year. Both school districts canceled classes on February 4 due to ice.

The Texas Education Agency requires districts to make up missed days.

Two Spring schools locked down during manhunt

  HOUSTON (KTRK) -- Students at two Spring ISD schools were placed on lockdown for nearly two hours Tuesday afternoon as a safety precaution.

According to Spring ISD spokesperson Karen Garrison, Smith Elementary and Twins Creek Middle School were placed on lockdown at the request of the Harris County Sheriff's Office. Deputies were searching for three burglary suspects in the area.

The schools went on lockdown at 12:45pm, and it was lifted just before 2:40pm.


Two of the three suspects were captured, and authorities say they know the identity of the third.
