DPS notifies DAs of possible false drug evidence

See it on TV? Check here. HOUSTON (KTRK) -- We've learned exclusive details about a serious situation that's impacting prosecutors' offices across the area.

The Department of Public Safety notified district attorneys last week that drug evidence used in cases as far back as 2006 may not have been tested correctly. The Harris County DA's Office is aware of approximately 12 cases affected.

Those tests were conducted by one of the DPS analysts out of the DPS Houston Regional Lab in northwest Houston. That analyst is now suspended.

The Montgomery County DA says his office has received a list of potential cases. We have also learned that the lab handles cases for Fort Bend, Galveston, Brazoria and Matagorda counties.

District attorneys offices in those counties are looking to see if the suspended lab technician handled any evidence in their criminal cases.

The Houston Regional Crime Lab received its DPS accreditation in December 2007 and that lasts until December 1 of this year. Technicians at this lab run tests on controlled substances, toxicology, DNA, firearm toolmarks and trace evidence. This is one of 13 DPS crime labs operating across Texas.
