Brothers charged in connection with assault, robbery of one of their girlfriends

See it on TV? Check here.   HOUSTON (KTRK) -- Two brothers have been charged in connection with assaulting and stealing money from one of their girlfriends.

On the night of May 6, court documents state Colin Vernon Smith asked his girlfriend where the cash was that she received from an auto accident settlement. She says when she told Colin Smith that he could not have the money, he became very angry, pushed her out of a chair, then grabbed her by the hair and slammed her head on the floor several times. The girlfriend alleges that he then hit her in the face twice.

After telling him that the money was in a dumpster in the hopes of getting him out of the Clear Lake area residence, she says Colin Smith called his brother, Justin Smith, who went to the dumpster to look for the strong box with the cash in it, but it was not there.

Investigators say Colin then told Justin to leave the residence, at which point Colin then hit his girlfriend and began to choke her. She says she finally relented and told him the money was in her child's toy box. She says Colin took the money and put it in a backpack.

According to court documents, the girlfriend says Justin, who police say was present when Colin took the month, told her he was sorry that his brother beat her up, but that he needed the money.

The girlfriend was treated at a hospital for a broken nose and other injuries, court documents show.

Colin Smith, 26, and Justin Smith, 24, are charged with aggravated robbery. No bond has been set in either case.

Man accused in death of girlfriend's infant

Sean Wheeler Sean Michael Wheeler, 23, has been charged with injury to a child.

  CHANNELVIEW, TX (KTRK) -- A Channelview man is facing a felony charge, accused of fatally injuring his girlfriend's baby boy.

Court documents state that on Wednesday, a mother and her boyfriend brought her five-week-old baby boy to San Jacinto Methodist Hospital in Baytown. The baby was unresponsive and medical staff attempted CPR, then pronounced the child dead. Doctors called police after they noticed numerous bruises on the baby's body.

The baby's mother told a deputy with the Harris County Sheriff's Office that her boyfriend, Sean Michael Wheeler, had agreed to watch the baby while she slept. She said Wheeler, who is not the baby's father, told her he was taking the boy for a ride in the car to help put him to sleep. When they returned a short time later, she said the baby wasn't breathing and was cold and limp, so she rushed him to the hospital.

Wheeler told authorities that while he was driving around with the baby, the child would alternately cry and then stop. He said he stopped to check on the baby once when he became quiet and noticed the child was breathing funny, so he returned home, got the baby's mother and they drove to the hospital.

Wheeler reportedly denied injuring the baby in any way, and claims he didn't shake him. While he told authorities he doesn't know how the baby got the bruises, Wheeler admits he was the only person with the infant when he stopped breathing.

Wheeler's attorney, Eric Dick, contacted ABC13 Eyewitness News and said, "He's completely innocent. He didn't do it. He didn't do anything wrong."

An autopsy showed the baby suffered bleeding on his brain and a blunt force injury to the back of the head. His death was ruled a homicide.

Wheeler, 23, has been charged with injury to a child. Bail has been set at $50,000.

Man borrows girlfriend's car, crashes it into garage

Police say a boyfriend who borrowed his girlfriend's car ends up crashing it into a garage.

  HOUSTON (KTRK) -- A man is in trouble with both police and his girlfriend after crashing her vehicle into a home overnight.

It happened at a home on Cedar Park at Silver Star in northwest Harris County. Police say the man took a curve too fast and then crashed his girlfriend's car into the garage of a home. He then took off, ran to his girlfriend's house, handed her the keys and then took off running.

Police are still looking for him.
